Microsoft software license purchase brokerage service

The City of Lodz - Lodz City Hall in Poland from Europe region has released this tender for [numbering consistent with the Technical Specifications] 4.1 The subject of the order is the conclusion of a framework agreement for brokerage services in the purchase of Microsoft software licenses under the MPSA (Microsoft Products and Services Agreement) sales programs. 4.2 A detailed description of the subject of the order can be found in Appendix No. 1 to the Technical Specifications and in the relevant provisions of the agreement, Appendix 5 to the Technical Specifications. 4.3 The Ordering Party does not envisage the submission of variant or partial offers. 6. ORDER COMPLETION TIME 6.1 Order completion deadline: from the date of conclusion of the agreement for a period of 36 months. 6.2 The deadlines for completing individual executive orders (delivery of Microsoft software licenses/subscriptions), the subject of which is covered by the framework agreement, are a maximum of 5 business days from the date of sending the order by the Ordering Party. This deadline depends on the Contractor's offer and constitutes a criterion for evaluating offers in the procedure for concluding the framework agreement. 1. You can contact the Data Protection Officer and his deputy on all matters concerning the processing of personal data by the City of Łódź Office and the exercise of rights related to data processing. 39.4 Providing personal data is a necessary condition for participating in a public procurement procedure. The general basis for data processing is Article 6 paragraph 1 letters b, c and e and Article 10 of the General Regulation. 39.5 The detailed purposes of data processing are indicated in the following provisions. a) the Act of 11 September 2019 – Public Procurement Law; b) the Act of 23 April 1964 – Civil Code; c) the Act of 27 August 2009 on Public Finances; d) the Act of 29 September 1994 on Accounting 39.6 Your data will be processed for the purpose of: a) conducting the public procurement procedure and selecting the contractor; b) concluding a contract; c) financial and accounting settlement; d) making available and updating in the Central Register of Contracts information on contracts concluded in written, documentary, electronic or other special form as a result of a resolved public procurement procedure. 39.7 Personal data may be shared with other entities authorized to receive them under applicable law, i.e., under Articles 18 and 74 of the Public Procurement Law; with experts with specialized knowledge, if appointed; with the Minister of Finance as the body managing and maintaining the Central Register of Contracts' IT system; and with any interested party due to the universal, public, and free access to data collected in the Central Register of Contracts via the website; and with recipients of data within the meaning of personal data protection regulations, i.e., entities providing postal, courier, IT, banking, and insurance services; with individuals and entities interested in the ongoing procurement procedure; and with entities using the Public Information Bulletin, the Public Procurement Bulletin, and the Competitiveness Database. If the contract value is equal to or exceeds the EU thresholds, the data will be transferred to the Publications Office of the European Union. 39.8 Furthermore, if the City of Łódź Office acts as the entity performing the tasks of the central contracting authority, the selected contractor's data will be transferred to the relevant municipal organizational unit for which the procedure is being conducted in order to conclude and settle the contract. 39.9 Personal data will not be transferred to third countries. 39.10 Personal data will be processed and stored for a period of 4 years, counted from the first of January of the year following the year in which the case was concluded, and then, in accordance with the provisions of the Act of 14 July 1983 on National Archival Resources and Archives, for a period of 5 years, in accordance with category B5, in the case of procedure documentation, and 10 years in connection with the concluded contract, in accordance with archival category B10, and in the event of a change in the archival category of the documentation, for a period consistent with the changed archival category of the documentation. In the case of contracts financed from European funds or funds other than those originating from the European Union budget based on separate provisions, this period can be up to 25 years. 39.11 Personal data will be stored at CRU for a period of 5 years, counted from the end of the year in which the contract concluded with the controller expires.
