The order is carried out as part of investment task no. SI/T1.132/26 titled: “Metro Construction”. 2. The subject of the order has been divided into the following stages: 1) Basic order: a) Stage Ia – preparation of a feasibility study with an indication of the recommended variant, b) Stage Ib – development of a technical concept, 2) Order subject to the right of option: a) Stage II (option I) – development of a detailed technical concept, b) Stage III (option II) – development of a project information sheet, c) Stage IV (option III) – development of a year-round environmental inventory together with a report on the project’s environmental impact and obtaining a decision on environmental conditions, d) Stage V (option IV) – development of a functional-utility program, e) Stage VI (option V) – determination of impact zones, assessment of the condition of buildings, analysis of dynamic impacts, f) Stage VII (option VI) – performance of detailed geological surveys, g) Stage VIII (option VII) – providing answers to bidders’ questions in the public procurement procedure for the development of design documentation or execution of construction works. 3. The Ordering Party may exercise the option right under the conditions specified in § 1 section 14 of the Draft Contract Provisions (hereinafter referred to as the PPU), constituting Appendix No. 1 to the ToR. 4. The Contractor is obliged to perform the subject of the order in accordance with the Description of the Subject of the Order (DOS) and its annexes, constituting Annex No. 1 to the SWZ. The scope of the subject of the contract and the Contractor's obligations are defined not only in the PPU, but also in the OPZ and Information Exchange Requirements (EIR), which constitute an integral part of the PPU and should be interpreted cumulatively. NOTE: Wherever a Polish Standard PN is indicated or cited, the Ordering Party accepts equivalent standards, in accordance with Art. 101, Section 4 of the Public Procurement Act. 5. Pursuant to § 10 of the PPU, the Contractor grants the Ordering Party a quality guarantee and warranty for the Documentation included in the Subject of the contract within Stages Ia – VIII for a period of 60 months. The quality guarantee and warranty periods run separately for each Stage from the date of acceptance of the Stage. 6. ORDER COMPLETION TIME LIMIT I. The Contractor is obligated to complete the subject of the order within the following time limits: 1) Basic order – within 18 months from the date of conclusion of the contract, i.e.: a) The Contractor is obligated to provide the Ordering Party with a material and financial schedule within 10 days from the date of signing the contract. This schedule should include the amount of remuneration referred to in § 8 section 1 item 1 of the PPU. The schedule will be presented to the Ordering Party for approval. The Ordering Party reserves the right to submit comments to the aforementioned schedule within 7 days of its submission by the Contractor. The Contractor is obligated to take into account the Ordering Party's comments and submit a revised schedule of works and expenditures within 5 days of receiving the Ordering Party's comments. If the Ordering Party exercises its option right, the Contractor is obligated to update the schedule of works and expenditures within 10 days of the date of delivery to the Contractor of the Ordering Party's statement of exercise of the option right. b) Stage Ia - preparation of the feasibility study, within 12 months of the contract conclusion date; c) Stage Ib - development of the technical concept, within 18 months of the contract conclusion date. 2) Order under the option - the completion deadline is up to 64 months from the contract conclusion date, i.e.: a) Stage II (option I) – up to 12 months, b) Stage III (option II) – up to 4 months, c) Stage IV (option III) – up to 22 months, d) Stage V (option IV) – up to 26 months, e) Stage VI (option V) – up to 14 months, f) Stage VII (option VI) – up to 24 months, g) Stage VIII (option VII) – up to 12 months, and the mobilization period referred to in § 1 section 14 item 3) of the PPU, counting from the date of notifying the Contractor of the exercise of the option right. II. The maximum deadline for completion of Stages Ia to VIII is 64 months from the date of conclusion of the contract. The Ordering Party may exercise the option right within a period of 14 to 38 months from the date of conclusion of the contract with respect to Stages II – VII, and with respect to Stage VIII within up to 51 months and 15 days. III. Detailed information on the deadlines for the execution of the order is specified in § 6 of the PPU, constituting Annex No. 1 to the SWZ. 7. Before the deadline for submission of offers, the Contractor is obliged to pay a security deposit in the amount of: PLN 400,000.00 (in words: four hundred thousand zlotys 00/100) and maintain them continuously until the expiry of the bid validity period, except for the cases referred to in art. 98 sec. 1 items 2 and 3 and sec. 2 of the Public Procurement Law. The requirements regarding the bid security are indicated in section XVIII of the Tender Offer Documents. 8. The description of the method of preparing the bid is specified in section X of the Tender Offer Documents. 9.
