the cost of additional orders resulting from 6 sec 7 1 5 7 2 3 and 8 Throughout the entire term of the Contract it may not exceed 50 of the contract value 40 3 The Ordering Party did not conduct initial market consultations before initiating the proceedings 40 4 Scope and conditions of changes to the concluded contract - issues relating to the contract are regulated in the Essential Provisions of the Contract Appendix No 7 to the Technical Specifications 33 REQUIREMENTS REGARDING EMPLOYMENT ON THE BASIS OF AN EMPLOYMENT RELATIONSHIP IN THE CIRCUMSTANCES REFERRED TO IN ARTICLE 95 OF THE PPL IF THE ORDERING AUTHORITY EXPECTS SUCH REQUIREMENTS Based on Art 95 of the Public Procurement Law the Ordering Party requires the Contractor or Subcontractor to employ on the basis of an employment relationship persons performing activities indicated by the Ordering Party within the scope of the contract performance if the performance of these activities consists in performing work in the manner specified in art 22 1 of the Act of 26 June 1974 Labor Code consolidated text Journal of Laws of 2025 item 277 i e activities of persons performing electrical work during the performance of the contract The type of activities related to the performance of the order and the method of verifying the employment of these persons and the Ordering Party s rights to control the Contractor s compliance with the requirements related to the employment of these persons and sanctions for non-compliance are specified in the contract template constituting Appendix No 7 to the SWZ 9 3 3 In order to demonstrate the absence of grounds for exclusion of the Contractor from the contract award procedure the Ordering Party requires the following documents 9 3 3 1 Declaration by the contractor within the scope of art 108 sec 1 point 5 of the Public Procurement Law on not belonging to the same capital group within the meaning of the Act of 16 February 2007 on competition and consumer protection consolidated text Journal of Laws of 2024 item 594 with another contractor who submitted a separate offer or a declaration of belonging to the same capital group together with documents or information confirming the preparation of the offer independently of another contractor belonging to the same capital group a template of the declaration constitutes Appendix No 10 to the ToR 9 3 3 2 Contractor s declaration on the validity of the information contained in the declaration referred to in art 125 sec 1 of the Public Procurement Act i e in the uniform ESPD document to the extent relating to the grounds for exclusion indicated in art 108 sec 1 points 3 6 of the Public Procurement Act in art 5k of regulation 833 2014 in the wording given by regulation 2022 576 and art 7 sec 1 of the Act on special solutions to counteract support for aggression against Ukraine and to protect national security A template of the declaration constitutes Appendix No 6a to the ToR In the case of contractors jointly applying for a contract the Contractor s declaration on the validity of the information contained in the ESPD is submitted by each of these Contractors this also applies to partners in a civil partnership If the Contractor relies on the resources of other entities a declaration on the validity of the information contained in the declaration referred to in Art 125 sec 1 of the Public Procurement Law i e in the single ESPD document to the extent relating to the grounds for exclusion indicated in Art 108 sec 1 items 3 6 of the Public Procurement Law Art 5k of Regulation 833 2014 as amended by Regulation 2022 576 and Art 7 sec 1 of the Act on special solutions to counteract support for aggression against Ukraine and to protect national security each of these entities shall also submit - template Appendix No 6b to the SWZ 9 3 3 3 Information from the National Criminal Register regarding the grounds for exclusion specified in art 108 sec 1 items 1 2 and 4 of the Public Procurement Act prepared no earlier than 6 months before its submission 9 9 18 If the data provided by the contractor do not allow the certificate to be found or verified in the Database on Certification of Public Procurement Contractors the Ordering Party shall request the Contractor pursuant to art 128 sec 1 or 4 of the Public Procurement Act to correct supplement or clarify the information concerning the certificate or to submit the appropriate Subjective Evidence In response to the request the contractor may refer to the certificate providing data enabling its unambiguous identification and verification If despite the request for reasons attributable to the contractor it is not possible to confirm the existence validity or proper scope of the certification the certificate will not be taken into account to the extent that cannot be verified Temporary unavailability of the certification database or other technical obstacle beyond the contractor s control does not constitute grounds for rejecting the certificate In such a case the Contracting Authority shall repeat the verification or take other actions provided for in the Public Procurement Law including contacting the certification body pursuant to Article 128 Section 5 of the Public Procurement Law with tender notice no. 665161-2026 published on 07 Oct 2026.
