The Agencja Mienia Wojskowego in Poland from Europe region has released this tender for 1. The subject of the contract is: provision of postal services for the Regional Branch of the Military Property Agency in Zielona Góra in domestic and international trade. 2. The Contracting Authority specifies the following conditions for participation in the procedure: 1) ability to engage in business transactions. The Contracting Authority does not impose any specific requirements in this respect. 2) authorizations to conduct specific business or professional activities, unless otherwise provided for in separate regulations. The Contractor must have a valid permit to conduct postal activities throughout the country, based on an entry in the register of postal operators, maintained by the President of the Office of Electronic Communications in accordance with Art. 6 of the Act of 23 November 2012 – Postal Law (consolidated text: Journal of Laws of 2026, item 55, as amended). 3) economic or financial situation. The Contracting Authority does not impose any specific requirements in this respect. 4) technical or professional capacity. Grounds for exclusion applicable in the procedure in question: Art. 108 sec. 1 of the Public Procurement Law, art. 7 sec. 1 of the Act of 13 April 2022 on specific solutions to counteracting support for aggression against Ukraine and to protect national security (i.e. Journal of Laws of 2025, item 514), the prohibition referred to in art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in connection with Russias actions destabilizing the situation in Ukraine. 4. The Contracting Authority will call on the Contractors whose offer was evaluated the highest to submit, within a specified time limit, not shorter than 10 days from the date of the call, the following subjective evidence, current as of the date of its submission, i.e.: CONFIRMING THE LACK OF GROUNDS FOR EXCLUSION: 1) Information from the National Criminal Register within the scope specified in art. 108 sec. 1 points 1 and 2 of the Act, drawn up no earlier than 6 months before its submission; 2) Information from the National Criminal Register within the scope of art. 108 sec. 1 item 4 of the Act, regarding the lack of a final judgment prohibiting from applying for public contracts as a penal measure, drawn up no earlier than 6 months before its submission; 3) The Contractor’s declaration, within the scope of art. 108 sec. 1 item 5 of the Act, on not belonging to the same capital group, within the meaning of the Act of 16 February 2007 on competition and consumer protection (i.e. Journal of Laws of 2025, item 1714), with another Contractor who submitted a separate offer or a declaration of belonging to the same capital group, together with documents or information confirming the preparation of the offer in the proceedings independently of another Contractor belonging to the same capital group – the template is attached as Appendix No. 4 to the Technical Specifications; 4) The Contractors declaration on the validity of the information contained in the declaration referred to in Article 125 paragraph 1 of the Act to the extent relating to the grounds for exclusion indicated in Article 108 paragraph1 points 3-6 of the Act – the template constitutes Appendix No. 7 to the SWZ or in the case of Contractors using a certificate, in order to demonstrate the absence of grounds for exclusion from the procedure under art. 108 sec. 1 points 1-5 of the Act: Contractor’s declaration on the validity of the information contained in the declaration referred to in art. 125 sec. 1 of the Act to the extent relating to the grounds for exclusion indicated in art. 108 sec. 1 point 6 of the Act – the template constitutes Appendix No. 7a to the SWZ 5) Contractor’s declaration on the validity of the information with regard to not being subject to the prohibition referred to in art. 5k sec. 1 of Regulation 833/2014 and not being subject to exclusion from the procedure in accordance with art. 7 sec. 1 of the Act with regard to counteracting the promotion of aggression – the template constitutes Appendix No. 8 to the SWZ; In the case of Contractors jointly applying for the award of a contract, the documents indicated in point IX sub-points 1. 1) – 1. 5) of the ToR shall be submitted by each Contractor separately.
