SWZ [within the scope of the grounds for exclusion under Article 5k) of Council Regulation (EU) No 833/2014 of 31 July 2014, as amended by Regulation 2025/2033 (OJ L, 2025/2033, 23.10.2025)] – the declaration should be submitted in accordance with the template constituting Annex No. 4 to the SWZ. These declarations constitute evidence confirming the absence of grounds for exclusion, and in the case of submitting a certificate – a declaration to the extent to which the certificate does not demonstrate compliance with these conditions - - Part II, section A of the ESPD (line concerning information whether the contractor is entered on the official list of approved contractors or holds an equivalent certificate). 1.3. The declaration referred to in Chapter IV, section 1, item 1.2. of the SWZ, letters a) – b) should be submitted in the form of a Single European Procurement Document, drawn up in accordance with the standard form specified in the European Commission Implementing Regulation issued on the basis of art. 59 paragraph 2 of Directive 2014/24/EU, hereinafter referred to as the "Single Document". The contractor is obliged to submit the ESPD to the extent indicated in Annex No. 3 to the ESPD. The Ordering Party hereby informs that the Instructions for completing the ESPD can be found on the website of the Public Procurement Office. 1.4. The ESPD template submitted by the Contracting Authority is compliant with Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing a standard form for the European Single Procurement Document. The Contractor is obliged to complete the ESPD to such an extent that the Contracting Authority is able to verify whether the Contractor is not subject to exclusion to the extent described in these ToR. 1.5. The declarations referred to in Chapter IV, section 1, item 1.2 of the ToR are submitted separately by: 1) the Contractor/each of the Contractors jointly applying for the contract award. In such a case, the declaration confirms that there are no grounds for exclusion of the Contractor in the procedure. 1.6. The Contractor is obliged to enclose with the offer: 1) the declarations referred to in Chapter IV, section 1, item 1.2.a) – b) SWZ – in the form of an ESPD (according to Appendix No. 3 to the SWZ), and point 1.2. c) SWZ – on the template attached to the SWZ; 2) an extract or information from the National Court Register, the Central Registration and Information on Business or another appropriate register confirming that the person acting on behalf of the contractor is authorized to represent it; 3) a power of attorney or other document confirming the authorization to represent the Contractor, if the authorization of the person submitting the offer does not result from the documents described in point 2); 4) in the case of contractors jointly competing for the contract: a) a power of attorney, the content of which will specify the authorization to represent them in the contract award procedure or to represent them in the procedure and conclude a public procurement agreement. The power of attorney should include, in particular, an indication of: - the public procurement procedure it concerns; - all contractors jointly applying for the contract, listed by name, with their registered office address; - the appointed attorney-in-fact and the scope of his or her power of attorney; b) the declaration referred to in Chapter I, section 4, item 4.4 of the ToR (the Ordering Party allows this declaration to be submitted on the offer form). 1.7. The Contractor is not obliged to submit the documents referred to in section 1.6, item 2) if the Ordering Party can obtain them through free and publicly available databases, provided that the Contractor has provided the data enabling access to these documents. 1.8. The provisions of section 1.6, item 3) shall apply mutatis mutandis to the person acting on behalf of contractors jointly applying for the contract.if the Ordering Party can obtain them using free and publicly available databases, provided that the Contractor has indicated data enabling access to these documents. 1.8.
