Purchase of a subscription to the Vmware virtualization system used at the Krakow City Hall

Tender Summary

The Krakow Municipality - Krakow City Hall in Poland from Europe region has released this tender for 1. The subject of the order is the purchase of a subscription for the VMware virtualization system used by the Krakow City Hall. A detailed description of the subject of the order is included in the contract template, which constitutes Appendix 9 to the Terms of Reference (hereinafter: STC). 2. The Ordering Party does not divide the order into lots in this procedure and does not allow for the submission of partial bids. The Ordering Party has not divided the order into lots because the subject of the order involves the purchase of two-year VMware Cloud Foundation subscriptions (SKU: VCF-CLD-FND) for 1304 processor cores, constituting a single and indivisible product offered by VMware. The subscriptions are delivered under the manufacturer's uniform licensing model and apply to a single virtualization environment operated by the Krakow City Hall. Splitting the order into lots would have no technical or organizational justification, as all subscriptions must be assigned to the same environment and ensure a uniform validity period and consistent scope of entitlements. A potential division of the contract could lead to unjustified difficulties in subscription management, billing, and vendor support, as well as increase the risk of inconsistencies in terms of subscription validity periods or subscription assignment to the Ordering Party's environment. Furthermore, splitting the contract would not contribute to increasing the competitiveness of the tender, as the subject matter of the contract covers the delivery of standard VMware subscriptions with pre-defined parameters, and contractors compete solely on price for an identical product. Considering the nature of the subject matter of the contract, its homogeneity, the manufacturer's requirements regarding the licensing model, and the need to ensure consistency and continuity of the virtualization environment, the Ordering Party has determined that splitting the contract into lots would be unjustified. Refraining from splitting the contract into lots does not preclude small and medium-sized enterprises from participating in the tender. 3. The Ordering Party does not require sheltered workshops, social cooperatives, or other contractors covered by the provisions of Article 94, paragraph 1 of the Act of 11 September 2019 - Public Procurement Law (consolidated text: Journal of Laws of 2026, item 793, as amended), hereinafter referred to as the "Act". 4. Due to the nature of this contract (delivery), the Ordering Party does not require the employment of persons (by the Contractor or subcontractors) on the basis of an employment relationship. 5. The Ordering Party does not envisage the possibility of awarding contracts referred to in art. 214 sec. 1 item 8 of the Act. 6. The Ordering Party does not allow the submission of variant offers. 7. The Ordering Party does not intend to conduct an electronic auction. 8. The Ordering Party did not conduct preliminary market consultations before initiating the procedure. 9. In this procedure, the Ordering Party does not require the Contractors to submit the evidence in question. 10. The Ordering Party,Within the limits specified in Article 462 et seq. of the Act, the Contractor may perform the subject of the contract using subcontractors. A Contractor who intends to subcontract part of the contract shall indicate in the offer the parts of the contract that it intends to subcontract and provide the names of any subcontractors, if already known. 11. Justification for the application of the 100% price criterion - The quality requirements referred to in Article 246, paragraph 2 of the Act have been specified by the Ordering Party in the description of the subject of the contract included in the contract template. with tender notice no. 685617-2026 published on 06 Oct 2026.
