The method of order execution is specified in the draft agreement – ​​Appendix No. 3 to the ToR – one-time delivery. 5. The offered subject of the order must be approved for trade and use in accordance with applicable law. 6. The subject of the contract must comply with the Act of 7 April 2022 on Medical Devices (consolidated text: Journal of Laws 2022.974 of 2022.05.09), if the Ordering Party requires the offering of an assortment constituting a medical device. 7. In all provisions of the Technical Specifications and their annexes, in which the Ordering Party refers to standards, approvals, technical specifications or reference systems, or in which trademarks, parameters or sources of origin (names of manufacturers or devices) are indicated, in accordance with art. 99 sec. 5 and art. 101 sec. 4 of the Public Procurement Act, the Ordering Party allows equivalent solutions. 8. The Ordering Party does not reserve the right to compete for the contract only by Contractors referred to in art. 94 of the Public Procurement Act. 9. The Ordering Party does not impose the requirements referred to in art. 96 sec. 2 item 2 of the Public Procurement Act. with tender notice no. 688984-2026 published on 07 Oct 2026.
