Delivery of the subject of the order together with transport, unloading and carrying to the Ordering Party's premises or to another place indicated by the Ordering Party on within the Czechowice-Dziedzice Commune will be at the contractor's expense and risk. 4. The supplied devices must come from an official distribution channel in Poland. 5. All solutions delivered under the order must be brand new and unused prior to the date of delivery to the Ordering Party's premises, excluding use necessary to test their correct operation. Refurbished devices and licenses are not permitted. 6. Delivered devices must be free from physical and legal defects. 7. The Ordering Party reserves the right to unilaterally extend the order, within its legal rights of option. 8. If the Ordering Party exercises its option right, the contractor is obligated to implement it under the terms and conditions specified in the contract. 9. The Ordering Party may exercise its option right within 7 days of concluding the contract by unilaterally submitting a declaration of intent to the contractor electronically. 10. A manufacturer's warranty for a minimum period of 60 months will be provided for the entire subject of the order. 11. The order is financed from the Ordering Party's own funds. 12. Relevant evidence: The Ordering Party requires the submission of the relevant evidence, which will be supplemented in accordance with the provisions of the Technical Specifications: 1) documents (catalog, folder or technical documentation) from the manufacturer of the offered devices, containing the quality parameters of the offered goods specified in Appendix No. 1 to the ToR in the points marked with the DT index. It is recommended that the above-mentioned documents confirming compliance with the requirements specified by the Ordering Party be appropriately marked, i.e. Contractors should mark the file/document with the item of the Description of the subject of the order – “Required minimum quality parameters” – it applies to; 2) a printout from the website https://www.cpubenchmark.net/cpu_list.php, on the date the Contractor prepares the document constituting the offer, confirming that the multi-core processors offered in the devices achieve a result in the PassMark CPU Mark test that meets the minimum quality requirements specified by the Ordering Party for workstations (point I.4.1, point II.4.1), laptop computers (point III.3.1); 3) an ISO 9001:2015 certificate or another document issued by an independent accreditation body, confirming that the offered workstations (point I.13.6, point II.13.6), laptop computers (point III.14.6) and monitors (point IV.1.7.6) were manufactured in an organization with an implemented quality management system; 4) an ISO 14001 certificate or another equivalent document issued by an independent accreditation body, confirming that the offered workstations (point I.13.7, point II.13.7), laptop computers (point III.14.7) and monitors (point IV.1.7.7) were manufactured in an organization with an implemented environmental management system; 5) statements by the manufacturer(s) confirming that the device servicing will be carried out directly by the manufacturer and/or in cooperation with the Manufacturer’s Authorized Service Partner; 6) a certificate issued by the manufacturer or a manufacturer's declaration confirming the authorization of the servicing company to provide servicing on behalf of the manufacturer; 7) ISO 9001 and ISO-27001 certificates or other equivalent documents issued by an independent accreditation body for the servicing entity to provide servicing; 8) declarations from the manufacturer(s) confirming that in the event of a hard drive failure in a device covered by active technical support, the damaged hard drive remains with the Ordering Party. 13. Equivalent solutions. 1. If the Ordering Party has indicated trademarks, manufacturer, supplier, approvals, designations of standards, patents or origin of materials, sources or a specific process that characterizes the products or services delivered by a specific Contractor in the description of the subject matter of the order, it is permissible to offer solutions equivalent to those described, provided that they maintain the same minimum technical, quality and functional parameters, etc. 2. A Contractor who refers to equivalent solutions is obliged to demonstrate that the solution offered meets the requirements specified by the Ordering Party. In such a case, the Contractor shall attach to the offer a list of equivalent solutions along with its description or standards. 3. If the description of the subject matter of the order contains references to standards, technical assessments, technical specifications and technical reference systems referred to in art. 101 sec. 1 item 2) and sec. 3 of the Public Procurement Law, the Ordering Party allows equivalent solutions. 14. Conditions regarding quality guarantee and warranty for defects. The Contractor shall provide a minimum 60-month manufacturer's warranty for the completed subject of the contract, including the materials used, from the date of the Parties' final acceptance of the subject of the contract.
