Purchase of electric buses – Part I

The Gmina Miejska Zgorzelec in Poland from Europe region has released this tender for 1. The subject of the order is the delivery of a brand new electric bus and a portable plug-in charger, hereinafter referred to as the "subject of the order." A detailed description of the subject of the order, including the minimum technical, functional, and quality requirements, are specified in the Technical Specification of the bus (hereinafter referred to as the "bus DSC") and the Technical Specification of the charger (hereinafter referred to as the "charger DSC"), constituting Appendix No. 6 to the Technical Specifications. 2. A detailed description and the terms and conditions for the execution of the order are specified in the draft agreement, constituting Appendix No. 5 to the Technical Specifications. 3. The Contractor is obliged to provide a warranty for the delivered subject of the contract as follows: 1) Electric bus - minimum 36-month full-vehicle warranty (unlimited mileage) for assemblies, systems, bus components, bus equipment, and software, excluding the traction battery, 2) Body perforation - minimum 10 years, 3) Traction batteries and storage device installed in the bus for its failure-free operation and completion of the declared mileage (min. 150 km) - minimum 96 months, 4) Portable plug-in charger - minimum 24 months - counting from the date of signing the acceptance protocol with the "I accept" clause. The warranty period referred to in point 1 of this section is one of the offer evaluation criteria under which the Contractor may receive additional points, in accordance with the principles set out in Chapter XIX of the Technical Specifications. The remaining minimum warranty periods required by the Ordering Party, referred to in points 2 to 4 of this section, do not constitute a criterion for offer evaluation. 4. The Contractor will be obliged to perform the subject of the contract in accordance with the "Do No Significant Harm" (DNSH) principle, referred to in Article 17 of Regulation (EU) 2020/852 of the European Parliament and of the Council, to the extent applicable to the subject of this contract. The Contractor undertakes to perform the subject of the contract in accordance with applicable legal provisions regarding environmental protection, waste management, and the treatment of batteries and accumulators, to the extent relevant to the performance of the subject of the contract. The Contractor undertakes to cooperate with the Ordering Party to the extent necessary to demonstrate compliance of the performance of the subject of the contract with the DNSH principle, if such an obligation results from the documents concerning the project referred to in Chapter III, Section 15 of the ToR, or applicable legal provisions. 5. The description of the subject of the contract is included in Chapter IV of the ToR.
