Purchase of medical equipment and accessories for medical devices

The Provincial Emergency Medical Service and Sanitary Transport Station in Poland from Europe region had released this tender for The subject of this order is the purchase of medical equipment and accessories for medical equipment. A detailed description of the subject of the order is set out in Appendix 2 to the Terms of Reference. The subject of the order must be free from physical and legal defects, brand new, not previously used by third parties, in particular, it has not been used for demonstration purposes, and is of good quality. It has also not been previously reconditioned. The offered medical devices covered by the subject of the order must meet the requirements specified in the Act of 7 April 2022 on Medical Devices (consolidated text: Journal of Laws of 2024, item 1620). The labeling of the supplied materials, instructions for use, and product descriptions must be prepared in Polish. The Contractor undertakes to perform the subject of the order in accordance with all the Ordering Party's requirements specified in the Specification of Technical Specifications. The Contractor is obliged to submit a bid for the entire given part(s), selected by the Contractor, including all items of the given part(s). All requirements specified in the order documents constitute minimum requirements, and their fulfillment is mandatory. Failure to meet the above requirements Failure to meet the minimum requirements will result in rejection of the offer as inconsistent with the terms of the contract pursuant to Art. 226 sec. 1 item 5 of the Public Procurement Act. If the Contracting Authority has indicated trademarks, patents, origins, sources, or a specific process that characterizes products or services provided by a specific Contractor in the description of the subject matter of the contract, it is permissible to offer solutions equivalent to those described, provided they maintain the same minimum technical, quality, and functional parameters. If the description of the subject matter of the contract contains references to standards, technical assessments, technical specifications, and technical reference systems referred to in Art. 101 sec. 1 item 2 and sec. 3 of the Public Procurement Act, the Contracting Authority will accept solutions equivalent to those described. A Contractor who cites equivalent solutions is obliged to demonstrate that the solution they offer meets the requirements specified by the Contracting Authority.
