The Contractor shall attach Appendixes No. 1A and 1B to the SWZ to the offer. By completing the indicated items in Appendix 1B to the SWZ-OPZ, the Contractor confirms compliance with the requirements specified by the Ordering Party. 3. The offered subject of the order must be complete, of a high standard in terms of both quality and functionality, as well as free from material, construction and legal defects. 4. The offered subject of the order must be approved for trading and use in accordance with applicable law. 5. The subject of the order must comply with the Act of 7 April 2022 on medical devices (consolidated text: Journal of Laws 2022, item 974, of 2022.05.09). 6. In all provisions of the Technical Specifications and their annexes, which indicate trademarks, parameters, sources, or a specific process that characterizes products supplied by a specific contractor of origin (names of manufacturers or devices), in accordance with Art. 99, sec. 5, and when the subject of the contract is described by reference to standards, technical assessments, technical specifications, reference systems, in accordance with Art. 101, sec. 4 of the Public Procurement Act, the Ordering Party allows equivalent solutions. In such a case, the Contractor is obliged to prove in the offer, in particular using the relevant means of evidence, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent degree. 7. The Ordering Party does not reserve the right to compete for the contract only for Contractors referred to in Art. 94 of the Public Procurement Act. 8. The Ordering Party does not impose the requirements referred to in Art. 96, sec. 2, item 2 of the Public Procurement Act. 9. Source of financing for the public procurement: The Ordering Party intends to finance the procurement relating to parts 5 and 6 from funds under the "Population Protection and Civil Defence Program for 2025-2026" grant. 10. The Ordering Party reserves the right to cancel the procurement procedure if the funds from the grant referred to above, which the Ordering Party intended to allocate to financing the procurement, are not awarded. with tender notice no. 689691-2026 published on 07 Oct 2026.
