Description of the subject of the contract - appendices No. 8 (regarding part 1 of the order), 9 (regarding part 2 of the order), 10 (regarding part 3 of the order), 11 (regarding part 4 of the order), 12 (regarding part 5 of the order) to the Specification of Terms of Reference - hereinafter referred to as the Technical Specifications. The Contractor may submit an offer for one, several or all lots of the order. The Contractor may submit an offer for a maximum of 5 lots of the order. The Contractor shall deliver the subject of the contract by its own transport and carry it in at its own expense and risk to the Ordering Party’s registered office, i.e. the room indicated by the Ordering Party in the building of the Lower Silesian Voivodeship Office in Wrocław, plac Powstańców Warszawy 1, 50-153 Wrocław. The procedure is being conducted as an open tender pursuant to Art. 132 of the Public Procurement Law and in accordance with the Technical Specifications. The Ordering Party envisages the application of the procedure referred to in Art. 139 of the Public Procurement Law. The Ordering Party: a) does not conduct proceedings to conclude a framework agreement, b) does not provide for settlement with the Contractor in foreign currencies, c) does not provide for an electronic auction, d) does not provide for the submission of offers in the form of electronic catalogues, e) does not provide for the granting of advance payments for the performance of the contract, f) does not allow the submission of variant offers, g) does not reserve the right to apply for the contract only to Contractors referred to in Art. 94 of the Public Procurement Act, h) due to the subject matter of the contract, does not impose requirements related to the performance of the contract, referred to in Art. 95 of the Public Procurement Act, i) does not provide for requirements regarding the employment of persons referred to in Art. 96 sec. 2 item 2 of the Public Procurement Act, j) does not provide for an on-site inspection at the place of delivery of the subject of the contract, k) pursuant to Art. 138 sec. 2 item 2 of the Public Procurement Act, the Contracting Authority shortens the time limit for the submission of offers, but not shorter than 15 days from the date of dispatch of the contract notice to the Publications Office of the European Union. The contracting authority is obligated to provide clarifications immediately, but no later than 4 days before the deadline for submitting offers in the case referred to in Article 138, paragraph 2, item 2 (in the case of a shortened deadline for submitting offers), provided that the request for clarification of the content of the tender specifications was received by the contracting authority no later than 7 days before the deadline for submitting offers. The draft provisions of the public procurement agreement, which will be incorporated into the concluded contract, constitute Annexes 2, 2a, 2b, 2c, and 2d to the tender specifications. The contract completion deadline is 30 days from the date of signing the contract. The contractor will be bound by the offer for a period of 90 calendar days. The first day of the offer validity period is the deadline for submitting offers. The contractor may subcontract part of the order. If the subject of the contract is to be executed using subcontractors, the Ordering Party requires the Contractor to indicate those parts of the contract that it intends to entrust to subcontractors and to provide the proposed subcontractor companies (Part II, Section D of the ESPD) – if known to the Contractor at this stage; further - point 8 of the ToR. The Ordering Party: a) does not require a bid bond; b) does not require the Contractor to provide a performance security. The Ordering Party has specified the conditions for participation in the proceedings in terms of technical or professional capacity. Detailed requirements in this respect are described in point 7.1.4 of the ToR.
