In connection with the above, the Ordering Party does not require that the subject of the order be implemented using the materials and products indicated by name. Therefore, a Contractor who offers to perform the contract using other materials and products is not obliged to submit a description of equivalent materials and products. 6. If the procedure documentation contains references to standards, technical assessments, technical specifications, and technical reimbursement systems referred to in art. 101 sec. 1 item 2 and sec. 3 of the Public Procurement Law, equivalent solutions are permitted. If equivalent solutions are offered, the Contractor is obliged to submit a description of the equivalent solutions with the offer and demonstrate that they meet the requirements specified by the Ordering Party. Whenever the description of the subject matter of the contract contains references to standards, technical assessments, technical specifications, and technical reference systems, the phrase "or equivalent" shall be added after their wording. 7. Pursuant to art. 393 sec. 1 point 4 of the Public Procurement Law, the Ordering Party will reject an offer if the share of products originating from European Union Member States, countries with which the European Union has concluded agreements on equal treatment of entrepreneurs, or countries to which the provisions of Directive 2014/25/EU apply by virtue of a Council decision, does not exceed 50% of the total value of the products covered by the offer. 8. The Ordering Party will reject an offer if the share of products (parts and components) in each of the delivered buses originating from countries that are parties to the GPA agreement concluded within the World Trade Organization (WTO) on government procurement and that have concluded free trade agreements with the European Union covering public procurement provisions does not exceed 50%. 9. Project co-financed under the European Funds for Western Pomerania 2021-2027 program, Priority 3 European Funds for a mobile Western Pomerania, Measure 3.1 Clean urban transport (ZIT). 10. In accordance with the rules governing the spending of funds, EU funds are intended, among others, to: implementation of a strategy for smart, sustainable, and inclusive growth. These objectives are achieved by spending funds in a way that ensures the creation of, among other things, high-quality jobs and environmental protection. 11. The procurement will be carried out in a way that ensures the best possible outcomes, including social, environmental, or economic outcomes, provided that any of these outcomes is achievable in a given procurement, in relation to the expenditures incurred, in accordance with horizontal principles. 12. The main objective of the project is to provide a good transport offer that guarantees safety and comfort of travel while simultaneously limiting the negative impact of transport on the environment by increasing the use of modern, low-emission urban transport. 13. Specific objectives of the project: 1) gradual implementation of sustainable transport solutions within the functional area of the city; 2) reduction of pollutant emissions into the atmosphere; 3) improvement of rolling stock accessibility for people with disabilities; 4) improvement of air quality in the project impact area; 5) reduction of the risk of behavioral climate-related diseases. 14. Pursuant to Articles 256 and 257 of the Public Procurement Law, the Contracting Authority reserves the right to cancel the contract award procedure: 1) before the deadline for submitting bids, if circumstances arise that make continuation of the procedure unjustified; 2) if the public funds that the Contracting Authority intends to allocate to finance all or part of the contract have not been awarded. 15. Reasons for not dividing the contract into lots: Pursuant to Article 362 item 1 of the Public Procurement Law, Article 91 section 2 of the Public Procurement Law does not apply to the award of sectoral contracts. However, the Contracting Authority hereby informs that it has not divided the contract due to the fact that the subject of the contract includes the delivery of four brand new MIDI class city buses, zero-emission, low-entry, low-floor, with electric drive, and one 60 kW mobile charger. The subject of the contract creates a single technologically interconnected system, the operation of which requires full compatibility. Dividing the contract into lots could lead to technical incompatibilities. Failure to comprehensively execute the contract could jeopardize its proper execution. Furthermore, the Contracting Authority would have difficulty enforcing its warranty/guarantee rights for defects, including due to the possibility of declaring different warranty/guarantee periods and the possibility of transferring liability to another Contractor. Not dividing the contract into lots does not restrict competition and ensures equal access for entities from the small and medium-sized enterprise sector. 16. In order to properly prepare the offer and estimate the costs of the service, the Contracting Authority, due to the specific nature of the subject matter of the contract, recommends conducting an on-site inspection. with tender notice no. 664475-2026 published on 28 Sep 2026.
