The price of a unit measurement of 1 km of cleared ditch, including the shoulder, includes: - measurement and preparatory works, - marking of works, - desludging and cleaning of the ditch, - cutting and refilling of the shoulder with ditch deepening and profiling, - cutting of grass and bushes, - removal and management of excavated material, - finishing works. In addition, the Contractor will include the prices of the above services in the unit price of the measurement (km). 4. The Contractor will provide, at its own expense, all necessary materials, means of transport, and equipment needed to complete the contract. 5. The order must be performed in accordance with the location specified in the Bill of Quantities and the requirements specified in the Description of the Subject Matter in a manner that guarantees appropriate quality. 6. The Ordering Party reserves the right to change the location of the desilting and cleaning of ditches. In the event of circumstances beyond the Ordering Partys control, it will designate an alternative location. 7. The Contractor is obligated to ensure safe traffic conditions for vehicles and pedestrians in the area of the works covered by the contract, based on the traffic management plan (for the duration of the works) approved by the Traffic Manager on provincial roads, submitted by the Ordering Party. a) The Ordering Party reserves the right to inspect the correct marking of the services performed in accordance with the traffic management plan. 8. The Contractor will commence the services covered by the contract after the official handover of the roadway. 9. The Contractor will maintain the roadway on an ongoing basis. 10. The Contractor is obligated to obtain third-party liability insurance at its own expense for the duration of the above order. 11. Copies of insurance policies or documents certified as true copies of the originals,The Contractor shall submit this information to the Ordering Party for review no later than the date of handover of the contract performance site and thereafter upon each request of the Ordering Party. Any delay in this respect will be treated as arising from reasons within the Contractors control and cannot constitute grounds for changing the contract completion date. 12. The Contractors remuneration will be determined as the product of the offered net unit price and the actual quantity of services performed. The Ordering Party will pay the Contractor remuneration for the actual quantity of services performed according to the unit prices specified in the contract. The minimum remuneration for the Contractor resulting from the reduction in the scope of the subject matter of the contract will be no less than 50% of the gross remuneration. 13. The Ordering Party will take into account social aspects, because the execution of the contract, in accordance with Art. 95 sec. 1 of the Public Procurement Law, requires the contractor or subcontractor to employ persons performing activities specified by the Ordering Party within the scope of the contract under an employment contract (drivers and equipment operators, persons performing manual work). The performance of these activities involves performing work in the manner specified in Art. 22 §1 of the Act of 26 June 1974 - the Labor Code (consolidated text: Journal of Laws of 2026, item 1245, as amended). 14. Pursuant to Art. 91 sec. 1 of the Public Procurement Law, the contract was not divided into lots (shorter road sections within the Road District) for organizational reasons. Involving more than one contractor for relatively short road sections would result in the involvement of more equipment than required. Dividing the contract into lots would increase the amount of equipment and employees involved in performing the service in question, increasing the cost of the service, the costs of transporting equipment and mobilizing several companies would exceed the value of the contract, and engaging excessive resources of the Ordering Party to coordinate several companies on a small order. 15. Contract completion date: 25 days from the date of signing the Agreement. 16. The roadway will be handed over after signing the agreement within 7 days from the date the Contractor notifies the Contractor of its readiness to commence the contract. 17. Delays in handing over the roadway, due to reasons attributable to the Contractor, cannot constitute grounds for changing the completion date. 18. Acceptance of the services performed by the Ordering Party will take place within 14 days of the date the Contractor reports completion of the work. 19. If defects are identified, the supervisor will determine the scope of corrections. The Contractor is obligated to remove them within 5 days of the date the Contractor is notified of the defects. 20. The Contractor will carry out corrections at its own expense and within a timeframe set by the supervisor or the person accepting the work, as appropriate. When requesting a re-acceptance, the Ordering Party may refuse to sign the acceptance protocol if defects are identified in the service. 21. A mutually signed acceptance protocol will constitute the basis for the Contractor to issue a VAT invoice.Validity period of the offer - The Contractor is bound by the offer until 20 January 2027.
