The Krakow City Roads Authority in Poland from Europe region has released this tender for Description of the subject of the contract: a) The subject of the contract is construction work consisting in the reconstruction of the “Bagatela” turnout junction and the road and track system on the section from the Bagatela Theatre to Garbarska Street together with the accompanying infrastructure as part of the investment task entitled: Reconstruction of the tram tracks at Straszewskiego Street and Karmelicka Street together with the accompanying junctions and infrastructure in Krakow. b) The Ordering Party has described the Subject of the contract using the following appendices: - Draft contract provisions (PPU), constituting Appendix No. 2 to the SWZ, - Technical specifications for the execution and acceptance of construction works (STWiORB) constituting Appendix No. 6 to the SWZ, - Design documentation constituting Appendix No. 7 to the SWZ, - Bill of quantities constituting Appendix No. 8 to the SWZ. c) The Ordering Party hereby informs that the Subject of the contract is co-financed from EU funds under: Project entitled "Reconstruction of the tram track on Straszewskiego and Karmelicka Streets, together with switch nodes and accompanying infrastructure in Krakow", co-financed by the EU under Measure FENX.03.01 Urban Transport, European Funds for Infrastructure, Climate and Environment 2021-2027. d) Required warranty period: The minimum warranty period is 36 months. The maximum warranty period is 60 months. Offers with a warranty period shorter than 36 months will be rejected. e) If any annex to the Technical Specifications contains manufacturer's names, trademarks, standards, approvals, technical specifications, and reference systems, products may be replaced with equivalent ones. The Ordering Party will consider equivalent solutions to be those that enable the effect intended by the Ordering Party to be achieved using other technical solutions. An identical (identical) solution cannot be considered equivalent, but only one that, in the compared features, indicates exactly the same or very similar utility value. By specifying manufacturer names, trademarks, standards, approvals, and reference systems, the Ordering Party intended to define the minimum quality parameters and performance characteristics that goods must meet to meet the requirements set by the Ordering Party, and these constitute only a quality benchmark for the subject of the contract. By specifying minimum quality parameter requirements, the Ordering Party understands the requirements for goods contained in publicly available sources, catalogs, manufacturer websites, and the like. The use of sample manufacturer names is solely intended to clarify the Ordering Party's expectations regarding a specific solution. The Ordering Party hereby informs that whenever the design documentation and technical specifications for the execution and acceptance of construction works indicate the origin (brand, trademark, manufacturer, supplier) of materials, or indicate standards, approvals, technical specifications, or reference systems referred to in Art.101 of the Public Procurement Law, the Ordering Party allows the offering of materials or solutions that are "equivalent" in terms of technical, functional, and operational parameters, provided that they guarantee the execution of the works in accordance with the issued building permit and ensure the achievement of technical parameters no worse than those assumed in this ToR, and that through their use, the functionality of the Subject Matter of the Order will be achieved to no lesser extent than if the Contractor used the solutions used in the design. f) Order completion deadline: 280 days from the date of conclusion of the contract. g) The Ordering Party, in accordance with Art. 95 sec. 1 of the Public Procurement Law, requires that the Contractor or Subcontractor employ, under an employment contract, persons performing the following activities, with the exception of persons performing so-called independent technical functions in construction within the meaning of the Building Law: - lower-level technical employees (organizing and executing construction works), - manual workers (directly performing construction works). Note! The Ordering Party allows for the possibility of personal execution of the order by persons conducting business activities or partners in a commercial law company. h) The Ordering Party does not require the submission of an offer after the on-site visit and the Contractor's verification of the documents necessary for the execution of the order available on-site at the Ordering Party's premises. with tender notice no. 698887-2026 published on 09 Oct 2026.
