The Ordering Party, pursuant to Art. 95 of the Public Procurement Law requires the contractor, subcontractor or further subcontractor to employ, on the basis of an employment relationship, persons performing the work covered by the subject of the contract, in accordance with the draft provisions of the contract constituting an annex to the Technical Specifications (SWZ) – this applies to persons performing: construction work, installation work covered by the scope of the contract. This requirement does not apply to activities covered by the subject of this contract that fall within the scope of responsibilities of persons performing functions in accordance with Chapter 7, point 7.2a) I. SWZ: construction managers, works managers. The contractor may entrust the performance of part of the contract to subcontractors. The Ordering Party allows equivalent solutions described in the SWZ – in accordance with the provisions of Chapter 4, point 1. SWZ. The Ordering Party reserves the right to stipulate that any proper names of materials (products) given in the SWZ or another document integral to the SWZ are not intended to violate Art. 99 of the Public Procurement Law, but are solely intended to specify the qualitative and technological expectations of the Ordering Party. This should be understood as defining the required minimum performance, functional and technical parameters or quality standards. In accordance with Art. 101 section 4 of the Public Procurement Law, if the description of the subject of the contract refers to standards, technical assessments, technical specifications and technical reference systems referred to in section 1 point 2 and section 3 of the Public Procurement Law, and such references are accompanied by the phrase "or equivalent", the Ordering Party accepts an equivalent solution described in each such standard, technical assessment, technical specification and technical reference system. An equivalent solution should be understood as a solution that will guarantee the proper execution of the works and ensure obtaining technical parameters not worse than those assumed in the order documents, will not lower the standards specified in the documentation and will ensure the execution of the contract in accordance with the expectations and requirements of the Ordering Party specified in the Specification of Technical Conditions, and such,which are characterized by parameters/descriptions no worse than those required and contained in the documentation. If the description of the subject matter of the contract refers to performance or functionality requirements referred to in art. 101 sec. 1 item 1 of the Public Procurement Law, the Contractor may rely on the compliance of the offered works, supplies, or services with the performance or functionality requirements specified by the contracting authority with the applicable standards, if these standards, technical assessments, specifications, and technical reference systems relate to the performance or functionality requirements specified by the contracting authority. All indications (names/marks/standards, etc.) indicated in the contract documentation are accompanied by the words "or equivalent." Therefore, as indicated above, the Contracting Authority, in each such case, allows the use of equivalent materials, devices, and solutions. In order to confirm compliance with the conditions for participation in the procedure, in appropriate situations and with respect to a specific contract, the Contractor may rely on the technical or professional capabilities or the financial or economic standing of other entities providing resources, regardless of the legal nature of the legal relationships it has with them under the terms specified in art. 118-123 of the Public Procurement Law. The Ordering Party requires the submission of a bid after the Contractor has conducted an on-site visit – in accordance with the provisions of chapter 3 item 14 of the Technical Specifications. Failure to conduct an on-site visit by the Contractor will result in rejection of its bid pursuant to art. 226 section 1 item 18 of the Public Procurement Law. Location of the on-site visit: Collegium Iuridicum Building, 90 Święty Marcin Street in Poznań. Dates of the on-site visit: a) Basic date: 3 September 2026, 12:00 PM, b) Back-up date (in the event that the Contractor is unable to conduct the on-site visit on the basic date): 10 September 2026, 12:00 PM. The cost of the on-site visit is borne by the Contractor. Confirmation of the on-site visit will be the inclusion of the Contractor in the list of entities participating in the on-site visit. The on-site visit should be conducted by an authorized representative of the Contractor.
