The Provincial Police Headquarters in Wrocław in Poland from Europe region has released this tender for 1. The subject of the contract is the service and calibration (at three measurement points: 0.10 mg/l; 0.25 mg/l and 0.70 mg/l) of AlcoSensor IV sobriety testing devices for Police units of the Lower Silesian Garrison over a 12-month period (1381437). 2. As part of the service, the Contractor will perform technical inspections, repairs, replacement of damaged and worn parts, replacement of consumables (batteries, accumulators, paper and ink ribbons), adjustments, and calibration of devices at three measurement points: 0.10 mg/l; 0.25 mg/l and 0.70 mg/l. 3. The Ordering Party requires that basic service services in the scope of service inspections be guaranteed for each device for measuring alcohol content in exhaled air, i.e. cleaning, maintenance, calibration, calibration and repair. 4. Calibration of devices for measuring alcohol concentration in exhaled air will be carried out in accordance with the Act of 11 May 2001 - Law on Measures (consolidated text: Journal of Laws of 2022, item 2063, as amended) and implementing provisions issued on its basis. 4.1. A positive result of tests of devices for measuring alcohol concentration in exhaled air is confirmed by the measures administration body or an accredited laboratory (PCA) with proof of calibration in the form of a calibration certificate and applies calibration marks to the measuring instrument in the number and places indicated in the type approval decision. 4.2. A calibration certificate (separately for each device) must be issued by an authorized entity, i.e. by the District Office of Measures or an accredited calibration laboratory with an accreditation certificate granted by the Polish Centre for Accreditation. 5. All servicing, maintenance, adjustment, and calibration activities must be performed in accordance with the Act of 11 May 2001 - the Law on Measures (consolidated text: Journal of Laws of 2022, item 2063, as amended), the implementing regulations to this Act, the technical and operational requirements and operating instructions for AlcoSensor IV devices for measuring alcohol content in exhaled air specified by the manufacturer of these devices, and the provisions of the Technical Specifications. 6. Detailed terms and conditions of the order execution are specified in the Draft Contract Provisions (Appendix No. 2 to the Technical Specifications; hereinafter referred to as the PPU). Completion of a service repair will be confirmed by a service report. A sample report is provided in Appendix No. 2 to the PPU. 7. The Contractor provides a 6-month warranty for the services performed, counting from the date of receipt of the equipment after properly performed service. 7.1. The Contractor provides a 12-month warranty on materials and spare parts used during the performance of the services in question, but not shorter than the manufacturers warranty. The warranty period runs from the date the device is accepted by the Ordering Party. 7.2. If a repair to the measuring device requires the replacement of parts, Contractors are obligated to use brand new parts,materials and elements, which shall be understood as such components and their elements that have not been subjected to a regeneration process or do not come from disassembly from other devices. 8. The Ordering Party requires that the offered service (equipment), including all ICT products, ICT services and ICT processes used to perform the contract, both as main elements and components, elements of the service provision environment or accompanying solutions, do not include, as of the date of submission of offers: 8.1. ICT products, ICT services or ICT processes indicated in the recommendation referred to in art. 33 sec. 4 of No. 329 709.82 of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the fundamental interest of state security; 8.2. ICT product the type of which was specified in the decision on recognizing the supplier as a high-risk supplier referred to in art. 67b sec. 15 of the Act of 5 July 2018 on the National Cybersecurity System, or the ICT services or ICT processes specified in this decision. 8.3. If the content of the offer, declaration or documents submitted with the offer or the Contractors explanations indicates that the offer includes the solutions referred to in points 8.1 - 8.2 above, such offer shall be subject to rejection pursuant to art. 226 sec. 1 item 17 or item 19 of the Public Procurement Law. 14. No later than the day before the commencement of the service, the Contractor is obliged to present to the Ordering Party documents concerning employment on the basis of an employment relationship, within the meaning of Art. 22 § 1 of the Act of 26 June 1974 - Labor Code (Journal of Laws of 2023, item 1465, as amended), of all persons performing servicing of vehicle speed measurement devices, including persons employed by subcontractors or further subcontractors, i.e.: 14.2.1. Declaration (list of employees) of the Contractor, subcontractor or further subcontractor regarding the employment of persons performing service activities for vehicle speed measurement devices under an employment contract. No later than the day before the commencement of the service, the Contractor is obliged to present to the Ordering Party documents concerning employment on the basis of an employment relationship, within the meaning of Art. 22 § 1 of the Act of 26 June 1974 - Labor Code (Journal of Laws of 2023, item 1465, as amended), of all persons performing servicing of vehicle speed measurement devices, including persons employed by subcontractors or further subcontractors, i.e.: 14.2.1.
