The Ordering Party will implement the subject of the contract in the scope of energy purchases: - basic (guaranteed) and - optional, in the event of exercising the option right. 4. The forecasted volume of electricity covered by the basic order is specified in the pricing table below. These amounts are estimates and were determined based on the Ordering Party's anticipated demand. The actual amount of electricity purchased may be less than the forecasted volume, which does not constitute non-performance or improper performance of the contract and does not give rise to any claims by the Contractor against the Ordering Party. 5. The Ordering Party anticipates the possibility of increasing the Forecasted Volume of electricity under the Option Right by a maximum of 15% of the Forecasted Volume, under the terms specified in the draft contractual provisions. 6. The Ordering Party reserves the right to exercise the option pursuant to Article 441, Section 1 of the Public Procurement Law. 7. The Ordering Party reserves the right to perform part of the order under the option right is an entitlement, not an obligation, of the Ordering Party. The Ordering Party may not exercise the option right, or exercise it to a lesser extent than specified in the DSC, and the Contractor shall not be entitled to any claims in this respect. 8. The Ordering Party anticipates the possibility of exercising the option right during the term of the contract. 9. If the Ordering Party exercises its option right, the Contractor is obligated to implement it under the terms and conditions specified in the contract. 10. The terms and conditions for the execution of the optional order will be the same as those applicable to the execution of the basic order. 11. The forecasted electricity demand for the period from January 1, 2027, to December 31, 2028, broken down by tariff, has been specified in the Excel file marked: "Description of the subject of the EE 2027-2028 order"; "Volume" tab. 12.Buy-Back of Electricity Generated in Renewable Energy Installations 1) The Order also covers the collection and settlement of electricity fed into the distribution grid from renewable energy source installations belonging to the Ordering Party; 2) The Contractor will be obliged to conclude an agreement with the Ordering Party regulating the principles of buy-back of electricity fed into the grid, consistent with the requirements specified in the Invitation to Negotiations and Appendix No. 3a) to the Invitation – “Minimum Requirements for Electricity Buy-Back Agreements”; 3) The Contractor is obliged to prepare a draft electricity buy-back agreement meeting the requirements specified in the Invitation and Appendix No. 3a) to the Invitation; 4) The method of settling electricity fed into the grid will depend on the legal status of a given RES installation and applicable law. 13. The Ordering Party has specified detailed conditions for the performance of the order in the draft provisions of the agreement, constituting Appendix No. 3 to the Invitation – PPU. 14. Electricity distribution services will be provided on the basis of separate agreements concluded between individual Ordering Parties (recipients/payers) and the relevant distribution system operator (DSO). with tender notice no. 687308-2026 published on 07 Oct 2026. 1.
