The quantitative scope of the subject of the order is an estimate determined by the Ordering Party with due diligence. Despite exercising due diligence, due to the nature of its business, the Ordering Party does not guarantee full execution of the order. 4. In order to confirm that the offered service complies with the Ordering Partys requirements, the above-mentioned evidence must be submitted with the offer. 5. The Ordering Party does not allow the submission of variant offers. 6. The Ordering Party reserves the right to change the quantity of goods ordered within individual assortment items and to place orders according to actual needs, provided that the total value of the supplies does not exceed the value of the contract. 7. The Ordering Party declares that the minimum guaranteed level of contract performance is 50% of the value of the awarded order. The Contractor is not entitled to claims for the performance of the contract to a greater extent. 8. The procedures for the award of a utilities contract are being conducted as an open tender under the provisions of the Act of 11 September 2019 - Public Procurement Law (consolidated text: Journal of Laws of 2024, item 1320, as amended), hereinafter referred to as the Public Procurement Act. 9. The procedures are being conducted in Polish. 10. The information obligation arising from Articles 13 and 14 of the Regulation of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L. 2016.119.1 of 4 May 2016) (hereinafter referred to as "GDPR") is fulfilled on the PGG SA website in the GDPR tab, in the "Contractors/Contractors Employees" attachment. In the case of processing personal data for purposes related to a public procurement procedure, the Ordering Party has fulfilled the information obligation in the Buyer Profile on the Polska Grupa Górnicza website in the "PZP Information Obligation" tab. 11. Additionally, the Ordering Party informs that a) the exercise by the data subject of the right to rectification or supplementation referred to in Article 16 of the GDPR may not result in a change in the outcome of the procurement procedure or an amendment to the provisions of the public procurement contract to the extent inconsistent with the Act. b) in the procurement procedure, submitting a request to restrict processing referred to in Article 18 paragraph 1 of the GDPR does not limit the processing of personal data until the procedure is completed. 12.The Ordering Party allows for the submission of partial bids for individual parts of the order (tasks) specified in Appendix No. 2 to the ToR.
