The purchase by the Ordering Party of the equipment referred to in paragraph 1 will be made under Grant Agreement No. U-29791/2026/00/656/2026/306, under Grant Project No. FENX.06.01-IP.03-0007/24 called “Infrastructure support for Mental Health Centers for adults and centers/teams of community psychological and psychotherapeutic care (reference level I)”, implemented under the European Funds for Infrastructure, Climate, Environment 2021-2027 Program, co-financed by the European Regional Development Fund, implemented on the basis of the Decision on co-financing Project No. FENX.06.01-IP.03-0007/24-00 taken by the Minister of Health on 28 February 2025, concluded by the Ordering Party with the State Treasury – Minister of Health (hereinafter referred to as the “Project”). 3. If the description of the subject of the contract contains references to standards, technical assessments, technical specifications and reference systems referred to in art. 101 sec. 1 item 2 and sec. 3 of the Public Procurement Act, the Ordering Party, in accordance with art. 101 sec. 4 of the Public Procurement Act, allows the use of solutions equivalent to those described. Whenever a standard, technical assessment, technical specification, or technical reference system is indicated in this ToR, it should be assumed that the phrase "or equivalent" is used in relation to them. 4. If the Ordering Party indicates a trademark, patent, origin, source, or specific process that characterizes products in the description of the subject matter of the contract, it should be assumed that the indicated trademarks, patents, origin, etc. define the minimum parameters indicated in Annex 6 to the ToR, which constitute the criteria used to assess equivalence. Whenever a trademark, patent, origin, source, or specific process that characterizes products is indicated in this ToR, it should be assumed that the phrase "or equivalent" is used in relation to them (legal basis: Article 99, paragraphs 5 and 6 of the Public Procurement Law). 5.In Appendix No. 6 to the ToR, the Ordering Party has specified quality requirements relating to at least the main elements comprising the subject matter of the contract. The Ordering Party hereby informs that in this open tender procedure, it envisages the possibility of applying the procedure referred to in Article 139, Section 1 of the Public Procurement Law.
