Tender Summary

The Commune of Węgierska Górka in Poland from Europe region has released this tender for 1. The subject of the order is the supply of equipment for the Communes of Węgierska Górka and the Communes of Lipowa for the purposes of the project entitled: “Climate protection using new technologies”. 2. The order has been divided into the following three lots: 1) Lot No. 1 – “Supply of computer equipment and GPS navigation devices”; 2) Lot No. 2 – “Supply of satellite phones”; 3) Lot No. 3 – “Supply of equipment for counteracting threats and eliminating their consequences”. 3. Under Lot No. 1, the Contractor will be obliged to supply: 1) for the Commune of Węgierska Górka: a) 4 sets of laptop computer equipment, b) 16 GPS navigation devices; 2) for the Commune of Lipowa: a) 2 sets of laptop computer equipment, b) 4 GPS navigation devices; – as part of the project entitled: “Climate protection using new technologies”. 4. Under part of order No. 2, the Contractor will be obliged to deliver 4 satellite telephones along with 8 subscriptions for the Commune of Węgierska Górka – as part of the project entitled: “Climate protection using new technologies”. 5. Under part of order No. 3, the Contractor will be obliged to deliver: 1) for the Commune of Węgierska Górka: a) 5 AVR 3kW generators, b) 4 3x4.5 m scissor-type tents, c) 24 helmet communication sets, d) 4 megaphones; 2) for the Lipowa Commune: a) 1 AVR 3kW generator, b) 1 AVR 200kW generator, c) 3 AVR 8.5kW generators, d) 1 trailer for a 200kW generator, e) 5 WT30X motor pumps, f) 1 floating motor pump, g) 1 3x4.5 m scissors-type tent, h) 1 10 m ladder, i) 6 under-helmet communication sets, j) 5 LEL meters, k) 5 megaphones; – as part of the project entitled: “Climate protection using new technologies”. 6. The detailed scope of the subject matter of all parts of the order is specified in Appendix No. 7 to the SWZ – Description of the Subject Matter of the Order, while the requirements for the performance of the order are specified in Appendix No. 8 to the SWZ – Draft Contract. 7. Equivalence clause: a) The Ordering Party, in accordance with the provisions of Art. 99 sec. 5 and Art. 101 sec. 4 of the Public Procurement Law, allows for equivalent solutions for supplies, works, materials, and systems that meet the requirements specified in the procurement documents. The Ordering Party reserves the right to specify that wherever trademarks, patents, or the origin of devices or materials are indicated in the description of the subject of the procurement in Annex No. 7 to the Technical Specifications – Description of the Subject of the Procurement, which constitutes a description of the subject of the procurement, these should be treated as proposals only. The Ordering Party allows for methods, materials, devices, systems, technologies, etc., equivalent to those presented in the description of the subject of the procurement. Therefore, it is permissible to propose in the offer any equivalent market equivalents with properties not worse than those indicated by the Ordering Party. The parameters specified in the procurement documents define the minimum technical, operational, usable, quality, and functional conditions that the subject of the procurement must meet. The offer may include methods, materials, devices, systems, and technologies, but with technical parameters,quality, performance, and functional properties. At the Ordering Party's request, the Contractor is obligated to prove that the solutions used will achieve all technical assumptions for the investment task in question, taking into account the entire investment, not a selected part of the whole. The burden of proving that the material or device is equivalent to the requirement specified by the Ordering Party rests with the Contractor. If the materials and/or devices offered by the Contractor as equivalent are not equivalent in light of the documents submitted by the Contractor, the Contractor's offer will be rejected as not compliant with the content of the Technical Specifications. The Ordering Party further indicates, in accordance with Art. 101, Section 4 of the Public Procurement Law, that wherever the description of the subject matter of the contract includes reference to standards, technical assessments, technical specifications, and technical reference systems, the Ordering Party accepts solutions equivalent to those described. In such a case, the procedure described earlier in this section shall apply accordingly; b) if the Contractor uses equivalent technologies, systems, materials, or devices in the valuation, the offer must be accompanied by a list of these technologies, systems, devices, or materials, which must include: the type and description of the technology or system used, the name of the device/material used, the manufacturer's name, and the precise and unambiguous type of device or material; c) in addition, for equivalent technologies/systems/devices/materials, the Ordering Party requires documentation of equivalence, including through calculations, detailed technical drawings, certificates, approvals, declarations of compliance with regulations and standards, and catalog cards from the manufacturers of equivalent devices/materials. These documents must clearly state the equivalence of the proposed technologies/systems/devices/materials; d) In the event of doubts regarding the equivalence of the substitute technologies/systems/equivalent devices/materials proposed in the offer, the Contracting Authority may require proof (documentation) of equivalence during the offer evaluation phase. In particular, the Contracting Authority may request that the Contractor submit manufacturer's catalogs for the given technology/systems/equivalent devices/materials. In particular, the equivalent technology/systems/equipment/materials will be assessed in terms of their ability to achieve the functionality, operating costs, and operational reliability levels specified for the technology/system/equipment/materials.The Contractor is responsible for ensuring that the material or device is equivalent to the requirement specified by the Ordering Party. If the materials and/or devices offered by the Contractor as equivalent are not equivalent in light of the documents submitted by the Contractor, the Contractor's offer will be rejected as not compliant with the Specification of Technical Specifications.
