The Fryderyk Chopin University Clinical Hospital in Rzesz w in Poland from Europe region has released this tender for 1 The subject of the order is the supply of needles for cryoablation of renal tumors along with the loan of a console for the ongoing needs of the Fryderyk Chopin University Clinical Hospital in Rzesz w 2 A detailed description of the subject of the order the estimated quantity and the technical functional and quality requirements are presented in Price and Offer Form Appendix No 1 to the ToR Description of the Subject of the Order - Summary of Required Parameters of the Console for Cryoablation Procedures Appendix No 2 to the ToR which are an integral part of the ToR 3 The console for cryoablation procedures offered for loan must meet the requirements specified in applicable law and the technical functional and quality requirements specified by the Ordering Party 4 Requirements regarding the manner of order execution in particular the rights and obligations of the Parties the principles of contract execution acceptance of the subject of the order payment terms liability of the Parties and other terms of order execution are specified in the Draft Contract Provisions constituting Appendix No 9 to the ToR These documents constitute an integral part of the Specification of Order Terms 5 The Ordering Party does not allow the submission of variant offers 6 The Ordering Party does not allow the submission of equivalent offers 7 The Ordering Party does not divide the contract into lots Therefore the Ordering Party does not allow the submission of partial offers as referred to in Article 7 Section 15 of the Public Procurement Law Reasons for not dividing the contract The subject of the contract is the supply of needles for cryoablation of renal tumors along with the loan of a console for the ongoing needs of the Fryderyk Chopin University Clinical Hospital in Rzesz w The offered console must ensure compatibility with consumables intended for cryoablation of tumor tissue in particular with cryoablation needles Dividing the contract into lots would result in technical difficulties and the need to coordinate the activities of various Contractors performing individual parts of the contract which could seriously jeopardize the proper execution of the contract 8 CONTRACT COMPLETION PERIOD 1 The contract completion period is 24 months from the date of conclusion of the contract 2 The Ordering Party allows for the possibility of changing the contract term in the event that the entire subject matter of the contract is not completed during the contract period due to the completion of lower-priced orders any amendment to the contract requires an annex provided that the Ordering Party unilaterally notifies the Contractor of the proposed contract extension before the expiry of the contract term 9 The Ordering Party reserves the right to exercise the option referred to in Art 31 sec 1 and Art 441 sec 1 of the Public Procurement Law under the terms and conditions described below 1 The Ordering Party may exercise the option right described in the ToR multiple times in whole or in part if the basic scope of the contract is exhausted during the contract term and the purchase of an additional quantity of the subject matter of the contract is in the Ordering Party s interest and results from its current needs however until the maximum scope of the option right is exhausted in accordance with the Price and Offer Form 2 an order executed under an option is a unilateral entitlement of the Ordering Party therefore failure to exercise the option right by the Ordering Party shall not constitute grounds for the Contractor to pursue any claims against the Ordering Party nor may the Contractor demand its execution 3 upon commencing the exercise of the option right the Ordering Party shall submit a demand for the items of the order together with a declaration that it will exercise the option right A template of the above declaration constitutes an Annex to the Agreement Failure to submit the above declaration constitutes a waiver of the optional order 4 upon submitting the declaration of exercise of the option the Ordering Party assumes a financial obligation in the amount resulting from the scope of deliveries the scope of deliveries will be specified in the submitted demand submitted on an ongoing basis after submitting the declaration of exercise of the option right 5 the principles governing the execution of an order covered by the option right will be the same as those applicable to the execution of the basic order The Ordering Party also reserves that the unit prices covered by the option will be identical to those in the basic order and will remain unchanged throughout the entire period of contract performance except for the situations described in the Draft provisions of the public procurement contract with tender notice no. 669936-2026 published on 07 Oct 2026.
