If the offer fails to provide data clearly identifying the offered product range or Appendix No. 5 to the Technical Specifications is not submitted with the offer, the Ordering Party will reject the offer pursuant to Article 226, paragraph 1, item 5 of the Act. The term "manufacturer" should be understood as the name of the company under which the offered product range is sold, or the entrepreneur introducing the product to the market in the territory of the Republic of Poland. 6. The Ordering Party requires that the offered ICT products do not include: 1) ICT products indicated in the recommendation referred to in art. 34 sec. 4 of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the fundamental interest of state security; 2) an ICT product the type of which was specified in the decision on recognizing the supplier as a high-risk supplier, referred to in art. 67 b sec. 15 of the Act of 5 July 2018 on the national cybersecurity system; Failure to meet the above requirement will result in rejection of the offer on the basis of art. 226 sec. 1 item 17 or item 19 of the Public Procurement Law (i.e. Journal of Laws of 2026, item 793, as amended). 7. Used by the Ordering Party in this documentation: • trademarks, patents or the origin, sources or specific process that characterizes products or services supplied by a specific contractor, referred to in art. 99 sec. 4 of the Act, and • standards, European technical assessments, approvals, technical specifications and technical reference systems referred to in Art. 101 sec. 4 of the Act - constitute solely a qualitative, functional, technical, technological, or aesthetic model, and in all cases of their use, the use of materials, devices, technical systems, and other equivalent elements, hereinafter referred to as "equivalent solutions," is permitted. Specified materials, devices, technical systems, and other elements of the description using "limiting wording" may be replaced by equivalent solutions with technical, technological, aesthetic properties, and qualitative or functional features not inferior to those described in this documentation. The use of "limiting wording" is not intended to favor a given manufacturer or their product, but merely to indicate a solution that should have properties and features not inferior to those specified in this documentation. In the case of offers containing equivalent solutions, the contracting authority will verify them in terms of meeting the requirements of individual items of the requirements contained in this documentation. The Contractor is obliged to prove in its offer the equivalence of the offered materials. The Ordering Party will not consider the offered solutions as equivalent if they have worse properties or characteristics than those indicated in this documentation. 8. The Ordering Party does not allow partial offers. 9. The Ordering Party allows for the execution of part of the order to be subcontracted. 10. The Ordering Party requests that the Contractor indicate in its offer the parts of the order that it will entrust to subcontractors, as well as the names of any subcontractors, if already known. 11. Contract completion date: no longer than 180 working days from the date of conclusion of the implementation agreement or acceptance of the request. 12. The procedure for awarding contracts based on framework agreements is described in Chapter XIX/XIXa of the Technical Specifications. 13. If, as a result of this procedure, an agreement is concluded with a single Contractor, the Ordering Party will award the public contract pursuant to Article 313 of the Act, i.e. on the basis of a framework agreement, the template of which is Annex XIXa to the Technical Specifications. 14. The type and scope of amendments to the contract are indicated in Chapter XIX/XIXa SWZ. 15. The Contractor is bound by his offer for 90 days from the deadline for submission of offers, with the first day of validity of the offer being the day on which the deadline for submission of offers expires, i.e. until 30 December 2026. 16. In accordance with art. 13 paragraphs 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (i.e. OJ EU L 119 of 04/05/2016, p. 1), hereinafter referred to as "GDPR", the Ordering Party informs that: 1) the controller of your personal data is the Commander of the Warsaw Police; 2) supervision over the proper processing of personal data is exercised by the personal data protection inspector: address: ul.
