The Ordering Party does not allow further division of the contract within individual lots. 4.3 The Contractor may submit an offer for one or more lots of the contract. 4.4 The Ordering Party does not allow the submission of variant offers. 4.5 The Ordering Party does not anticipate the possibility of awarding contracts referred to in art. 214 section 1 item 8 of the Public Procurement Act. 2.1 The procedure for the award of this public contract is conducted on the basis of the provisions of the Act of 11 September 2019 - Public Procurement Law - hereinafter referred to as the "Public Procurement Act" - and implementing provisions issued on its basis, in particular the Regulation of the Minister of Development, Labour and Technology of 30 December 2020 on the subjective means of evidence and other documents or declarations that the contracting authority may request from a contractor - hereinafter referred to as the "MR Regulation" - in an open tender. 2.2 Pursuant to Art. 139 of the Public Procurement Act, the Contracting Authority will first examine and evaluate the offers, and then subjectively qualify the contractor whose offer was rated the highest, in terms of the absence of grounds for exclusion and compliance with the conditions for participation in the procedure. 2.3 Pursuant to Art. 257 of the Public Procurement Act, the Contracting Authority reserves the right to cancel the procedure if the funds that the Contracting Authority intended to allocate to finance all or part of the contract are not awarded to it.
