Purchase by the Ordering Party of the equipment referred to in sec. 1 will be made under the Agreement No. UM_WR.431.3.281.2025 for co-financing the project "Retrofitting the Regional Specialist Hospital in Grudziądz with equipment and furnishings as part of medical rehabilitation" No. FEKP.06.09-IZ.00-0027/25 co-financed by the European Regional Development Fund under Priority 6 European funds for increasing the accessibility of regional infrastructure for residents, Measure 6.9 Investments in health infrastructure, Specific Objective 4 (v.) Ensuring equal access to health care and supporting the resilience of health care systems, including primary health care and supporting the transition from institutional care to family and community care of the European Funds for Kujawy and Pomerania 2021-2027 program, concluded between the Ordering Party and the Kujawsko-Pomorskie Voivodeship (hereinafter referred to as the Managing Authority) represented by the Voivodeship Board Kujawsko-Pomorskie (hereinafter referred to as: Project). 3. If the description of the subject of the contract contains references to standards, technical assessments, technical specifications and reference systems referred to in art. 101 sec. 1 item 2 and sec. 3 of the Public Procurement Law, the Ordering Party, in accordance with art. 101 sec. 4 of the Public Procurement Law allows the use of solutions equivalent to those described. Whenever a standard, technical assessment, technical specification, or technical reference system is indicated in this ToR, it should be assumed that the phrase "or equivalent" is used in relation to them. 4. If the Ordering Party indicates a trademark, patent, origin, source, or specific process that characterizes products in the description of the subject of the contract, it should be assumed that the indicated trademarks, patents, origin, etc. define the minimum parameters indicated in Appendix No. 6 to the ToR, which constitute the criteria used to assess equivalence. Whenever a trademark, patent, origin, source, or specific process that characterizes products is indicated in this ToR, it should be assumed that the phrase "or equivalent" is used in relation to them (legal basis: Art. 99 sec. 5 and 6 of the Public Procurement Law). 5. The Ordering Party has specified in Appendix No. 6 to the Technical Specifications quality requirements relating at least to the main elements constituting the subject of the contract. The Ordering Party informs that in the present proceedings conducted as an open tender, it envisages the possibility of applying the procedure referred to in Article 139, paragraph 1 of the Public Procurement Law. Using the above-mentioned procedure, the Ordering Party will first examine and evaluate the offers, and then subjectively qualify the Contractor whose offer was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the proceedings. with tender notice no. 661252-2026 published on 25 Sep 2026. 1.
