Pursuant to Art. 257 of the Public Procurement Law, the Ordering Party allows for the cancellation of this procedure if the funds that the Ordering Party intended to allocate to finance all or part of the contract are not awarded to it. 7. The Ordering Party allows for the application of the so-called reverse procedure referred to in Art. 139 sec. 1 of the Public Procurement Law, i.e. the Ordering Party will first examine and evaluate the offers, and then select the Contractor whose offer was rated the highest, in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure. 9. The Contractor is bound by its offer from the deadline for submission of offers until 10 February 2027 (90 days). 10. The offer must consist of: 10.1. the Contractor's offer form – an interactive form available on the e-Procurement Platform; 10.2. the declaration referred to in chapter VII point 1 of the SWZ - ESPD – an interactive form available on the e-Procurement Platform; The Contractor must attach to the Offer a declaration, valid on the date of submission of offers, that he is not subject to exclusion and meets the conditions for participation in the procedure. The Contractor shall submit this declaration in the form of the Single European Procurement Document, hereinafter referred to as the ESPD, constituting Annex No. 2 to Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing the standard form for the Single European Procurement Document. The information contained in the ESPD constitutes preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the procedure; 10.3. the declaration referred to in chapter VII point 1a of the SWZ - (as applicable) Declarations appendix no. 5.1 and 5.2 to the SWZ; 10.4. (if applicable) the obligation of the entity providing the resources, referred to in chapter VII point 6 of the SWZ; 10.5.(if applicable) demonstration of the reservation of information constituting a trade secret in accordance with chapter X, point 6; 10.6. document(s) constituting the basis for signing the Offer in accordance with chapter X, point 18 of the ToR; (if applicable) appropriate powers of attorney in accordance with chapter X, point 19 of the ToR; 10.7. SUBJECT EVIDENCE confirming that the supplies offered by the Contractor meet the requirements specified by the Ordering Party, the features of the description of the offered subject of the order - technical specifications of the offered subject of the order, together with any Information for Contractors – allowing for determining the compliance of the offered subject of the order with the Ordering Party’s requirements presented, respectively, in Appendix No. 3 to the ToR – completed Appendix No. 3 to the ToR – Contractor’s Offer. The Ordering Party considers the Contractor’s Offer indicated by the Contractor in Appendix 3 to the ToR as the subject evidence – confirmation of meeting the requirements through the parameters offered by the Contractor. The requirement to indicate "Name, type, model, manufacturer" does not constitute evidence in question. Pursuant to Art. 107 of the Public Procurement Law, if the Contractor fails to submit the evidence in question, or the evidence submitted is incomplete, the Contracting Authority will request its submission or supplementation within a specified timeframe. This rule does not apply if the evidence in question serves to confirm compliance with the characteristics or criteria specified in the description of the offer evaluation criteria, i.e., the Contractor's indication of information assessed in the offer evaluation criteria is not subject to supplementation/submission pursuant to Art. 107, sec. 3 of the Public Procurement Law, or despite submitting the evidence in question, the offer is subject to rejection, or there are grounds for invalidating the procedure.The Contracting Authority will request their submission or supplementation within a specified timeframe.
