The integrated nature of the system means that the provision of support services should be carried out by a single entity responsible for the overall operation of the system. The lack of division into lots does not in any way limit access to the contract for small and medium-sized enterprises, and Contractors operating in the industry covered by the subject of the contract may deliver all its elements. 3. The Ordering Party does not require the performance of the contract by sheltered workshops, social cooperatives or other contractors covered by the provision of art. 94 sec. 1 of the Act of 11 September 2019 - Public Procurement Law (i.e. Journal of Laws of 2026, item 793, as amended), hereinafter referred to as the "Act". 4. The Ordering Party, pursuant to art. 95 sec. 1 of the Act, requires that the Contractor (or subcontractor) employ on the basis of an employment relationship persons providing the CALL CENTER type remote assistance service referred to in point 5 of the Annex to the Agreement. The performance of these activities consists in providing work in the manner specified in art. 22 § 1 of the Act of 26 June 1974 – the Labor Code (consolidated text: Journal of Laws of 2025, item 277, as amended). (This requirement does not apply to bidders: (i.e. natural persons conducting business activities and partners in partnerships who undertake to personally perform these activities for the company.) 5. The Ordering Party does not envisage the possibility of awarding contracts referred to in art. 214 sec. 1 item 7 of the Act. 6. The Ordering Party does not allow the submission of variant offers. 7. The Ordering Party does not intend to conduct an electronic auction. 8. The Ordering Party did not conduct preliminary market consultations before initiating the procedure. 9. In this procedure, the Ordering Party does not require Contractors to submit the evidence in question. 10. The Ordering Party, within the limits specified in art. 462 et seq. of the Act, allows the possibility of the Contractor performing the subject of the contract using subcontractors. A Contractor who intends to entrust the performance of part of the contract to subcontractors shall indicate in its offer the parts of the contract the performance of which it intends to entrust to subcontractors and provide the names of potential subcontractors, if already known. 11. Justification for the application of the 80% price criterion - Quality requirements referred to in art. 246 sec. 2 of the Act, the Ordering Party described in detail in the Agreement template with annexes. with tender notice no. 658087-2026 published on 24 Sep 2026.
