The subject of the contract is the provision by the selected Contractor (also referred to as the "Financial Intermediary") of financial intermediation services consisting in the granting and comprehensive servicing of loans to micro, small, and medium-sized enterprises under "Loan Package 2 (mortgage, investment, working capital) from funds derived from repayment of financial instruments under the Regional Operational Program – Lubuskie 2020." The detailed terms and conditions under which the Loans will be granted, as well as the rights and obligations of the Contractor and the Ordering Party (related to the implementation of the subject of the contract) are described in the Agreement template constituting Appendix No. 1 to the ToR. The Contractor, using the Funds provided by the Ordering Party, will grant Loans on its own behalf, but on behalf of the Ordering Party, in accordance with the terms and conditions specified in these ToR (including the agreement constituting Appendix No. 1 to the ToR) and on the basis of the Agreement concluded with the Ordering Party (according to the template constituting Appendix No. 1 to the ToR). 2. The Financial Intermediary (Contractor) selected in this procurement procedure will be required to enter into an agreement with the Ordering Party concerning the provision of services covered by this procurement, in accordance with the template constituting Appendix 1 to the ToR. The Agreement template defines the detailed scope of rights and obligations of the Contractor and the Ordering Party. 3. For the purpose of fulfilling the procurement, the Contractor will provide at least one customer service point (CSP) located within the Lubuskie Voivodeship. 4. The Contractor is responsible for the credit risk arising from its lending activities. 5. The procurement has been divided by the Ordering Party into four separate parts (Service I, Service II, Service III, Service IV), as referred to in Chapter VIII of the ToR. 6. The amount of funds made available by the Ordering Party for the execution of the basic procurement (all four separate parts of the procurement referred to in Chapter VIII of the ToR) (without option rights) is PLN 32,000,000.00 (in words: thirty-two million 00/100). The amount provided does not constitute the estimated value of the order. 7.
