The subjective means of evidence indicated in Chapter X may be replaced by a valid certificate of the public procurement contractor referred to in Article 124, paragraph 2 of the Public Procurement Law, only to the extent that the certificate confirms the absence of grounds for exclusion or compliance with the conditions for participation in the procedure (if conditions were specified in the procedure) to the extent corresponding to the requirements specified in the Technical Specifications. The certificate does not replace subjective evidence regarding the grounds for exclusion not covered by the certification, in particular Art. 108 sec. 1 item 6 of the Public Procurement Law, Art. 109 sec. 1 item 6 of the Public Procurement Law, Art. 7 sec. 1 of the Act of 13 April 2022 on specific solutions for counteracting support for aggression against Ukraine and serving to protect national security, as well as circumstances arising in the course of this procedure. 2. The certificate replaces subjective evidence only to the extent covered by a valid certification and indicated by the contractor in the declaration referred to in Art. 125 sec. 1 of the Public Procurement Law. If the certificate covers only part of the grounds for exclusion or part of the condition (if the conditions were specified in the procedure) for participation in the procedure, or confirms compliance with the condition at a level lower than that required in the tender specification, the contractor shall submit subjective evidence in the remaining scope. 3. To the extent resulting from a valid certificate, the contracting authority shall not request other subjective means of evidence from the contractor, subject to art. 124 sec. 4 of the Public Procurement Law and art. 31 sec. 6 of the Act on the Certification of Public Procurement Contractors. 4. Pursuant to art. 126 sec. 1 of the Public Procurement Law, the contracting authority, before selecting the most advantageous offer, shall request the contractor whose offer was rated the highest to submit, within a specified time limit, not shorter than 10 days from the date of the request, subjective means of evidence indicated in Chapter X, current as of the date of submission, to the extent to which they have not been replaced by a valid certificate of the public procurement contractor, taking into account the following provisions: 1) If the introductory statement referred to in art. 125 sec. 1 of the Public Procurement Law, it follows that the contractor will use a certificate, and the contractor has provided data concerning the certificate enabling the contracting authority to independently verify the certificate in the certification database, the contracting authority will not request the contractor to submit subjective evidence to the extent that the circumstances required by the contracting authority result from that certificate. 2) If the certificate does not cover all the circumstances required by the contracting authority, the contracting authority will request the contractor to submit subjective evidence only to the extent not covered by the certification. 3) If the data provided by the contractor do not allow the certificate to be found or verified in the certification database, the contracting authority may request the contractor to submit, supplement, correct or explain this data under the terms of art. 128 sec. 1 or 4 of the Public Procurement Law. If, despite the request, the contracting authority is unable to verify the certificate, the certificate will not be taken into account to the extent that cannot be verified. 4) If the data necessary to assess the circumstances confirmed by the certificate have not been disclosed in the certificate or in the certification database due to their legally protected nature, the contracting authority may demand that the contractor disclose this data or consent to the certification body disclosing it to the contracting authority, pursuant to Art. 31 sec. 6 of the Act on Certification of Public Procurement Contractors. 5) If the contracting authority receives information indicating that the contractor has misled the certifying body, which could have had a significant impact on the granting of certification of public procurement contractors, or that the contractor has ceased to meet the conditions for granting this certification (if the conditions were specified in the procedure), the contracting authority, pursuant to Art. 128a sec. 1 of the Public Procurement Law, will request the contractor to provide explanations within a specified time limit, not shorter than 5 days from the date of the request. If the contracting authority deems the contractor's explanations insufficient, it will apply Art. 128a sec. 2 of the Public Procurement Law. 6) In the event of suspension of the validity of the certification of public procurement contractors during the procedure, the contracting authority, pursuant to Art. 128a section 3 of the Public Procurement Law, the contracting authority will request the contractor to submit, within a specified time limit of no less than 5 days from the date of the request, relevant evidence to the extent that the submitted certificate was intended to confirm the absence of grounds for exclusion or the fulfillment of the conditions for participation in the procedure for the purposes of this procedure (if the conditions were specified in the procedure). The provisions of Art. 128 sec. 2-5 of the Public Procurement Law shall apply accordingly. 7) If the certificate loses its validity in whole or in part during the procedure, the certificate will not be taken into account to the extent to which it has lost its validity.
