DZ-IV-A/66/2026 concluded between WSZ in Konin and the Wielkopolska Voivodeship for the granting of a subsidy for the purchase of a hysteroscopy set for the Gynecology and Obstetrics Ward; c. Packages numbers 3-4 under agreement no. DZ-IV-A/33/2026 concluded between WSZ in Konin and the Wielkopolska Voivodeship for the granting of a subsidy for the retrofitting of the Central Sterilization Room by purchasing a steam sterilizer with a tool washer (disinfector). 4. The order allows for the submission of partial offers. The item of order has been divided into lots (packages). 5. The order allows for the submission of offers for one, several or all lots. 6. The item of order will be delivered at the cost, risk and transport. Fig. 7. Conditions of implementation of the item of order. are also included in the PPU, constituting Appendix No. 5 to the SWZ. 8. The minimum guaranteed value of orders that the Employer will undertake to submit is: 100% of the contract value. 9. The Employer does not allow the submission of variant offers. 10. If the DSC uses an indication of trademarks, patents or the origin, source or a specific process that characterizes the products or services delivered by a specific contractor, this should be understood in such a way that each time such an indication is accompanied by the expression "or equivalent". 11. By the term "or equivalent", the Employer understands the offering of materials that guarantee the execution of the task in accordance with the requirements of the Employer and ensure the achievement of technical parameters not worse than those assumed in the SWZ. The use of equivalent solutions may not lead to a deterioration of the properties of the item ordered in relation to those specified in the original documentation, nor to a change in the price, nor to a violation of the law. 12. Possible inclusion of In the OPZ, the names of products or manufacturers are used only for the purpose of example, i.e. to approximate the requirements that could not be described using sufficiently precise and understandable terms. The possibly indicated names of products and their manufacturers are not intended to violate the principle of fair competition and equal treatment of contractors. Wherever they are indicated, they should be read in such a way that they are accompanied by the term "or equivalent." 13. At the same time, the requirements must be met in terms of: - dimensions and structure (size, type,physical properties and number of components); - functional nature (identity of function); - technical parameters (strength, durability, technical data, structures); - operational safety parameters; - emission standards. The above requirements constitute equivalent criteria. 14. The Ordering Party allows the delivery of products or equipment equivalent in relation to the OPZ, i.e. that the offered item of order will have the same or higher technical, qualitative, functional and operational parameters as those indicated in the OPZ. 15. Trademarks, proper names, etc. indicated in the OPZ (if any) constitute exclusively a quality standard for the item of order. In all cases in which, due to the specificity of the item of order, names of products, equipment or materials are indicated, the use of equivalent products, equipment or materials is permitted, i.e. all materials mentioned by name used in the description of the item. The contracting authority shall only serve to define the standard and may be replaced by others with no worse operational and quality parameters. In the case of offers containing equivalent solutions, the contracting authority shall verify them in terms of meeting the requirements of individual items of technical specifications contained in the annexes to the technical specifications. The contractor is obliged to prove in the offer the equivalence of the offered range. The burden of proving the equivalence is on the contractor. The contracting authority shall not accept equivalent solutions if they are worse than the minimum quality requirements indicated in the annexes to the technical specifications. 16. Pursuant to art. 101 sec. 5 of the Public Procurement Act: if the technical specifications refer to standards, technical assessments, technical specifications and technical reference systems referred to in art. 101 sec. 1 item 2 and sec. 3 of the Public Procurement Act, the contracting authority cannot reject an offer solely because the offeror of construction, supply or service work does not meet the requirements of the offeror. are not compliant with the standards, technical assessments, technical specifications and technical reference systems to which the OPZ refers, provided that the contractor proves in the offer, in particular by means of the items of evidence referred to in art. 104-107 of the Public Procurement Act, that the proposed solution meets the requirements specified in the OPZ to an equivalent degree. 17. Pursuant to art. 101 sec. 6 of the Public Procurement Act: if the OPZ refers to the performance or functionality requirements referred to in art. 101 sec. 1 item 1 of the Public Procurement Act, the contracting authority may not reject an offer that is compliant with a Polish Standard transposing a European standard, standards of other EEA Member States transposing European standards, with a European Technical Assessment, with a common technical specification, with an international standard or with a technical reference system established by Europe. a standardisation body, if these standards, technical assessments, specifications and technical reference systems concern the performance or functional requirements specified by the contracting authority, provided that the contractor proves in the offer, in particular by means of the items of evidence referred to in Art. 104-107 of the Public Procurement Law, that the construction, supply or service object meets the performance or functional requirements specified by the contracting authority.
