The Warsaw City Hall, Praga-Południe District in Poland from Europe region has released this tender for 1. The subject of the contract is winter cleaning of municipal roads in the Praga-Południe District of the Capital City of Warsaw in the seasons 2026/2027, 2027/2028, 2028/2029, 2029/2030. The subject of the contract includes the following works: a) plowing – clearing snow, making the road passable and enabling movement on pedestrian routes, in conditions of snowfall above 5 cm, b) spreading appropriate chemicals, in accordance with the Regulation of the Minister of the Environment of 27 October 2005 on the types and conditions of use of agents that can be used on public roads, streets and squares (Journal of Laws of 2005, No. 230, item 1960), on the road surface and/or pedestrian routes in doses adapted to the existing needs and weather conditions, c) eliminating slipperiness from the road surface and/or pedestrian routes by manual and mechanical sprinkling with sand, d) clearing and removal of snow and/or ice as directed by the Ordering Party, e) collecting and removing slush, snow, ice and other contaminants from the road surface and pedestrian routes, f) emergency ploughing, spreading with chemicals and/or sand, removing slipperiness, collecting and removing slush, snow, ice and other dirt from bicycle paths, g) manual and/or mechanical sweeping of sand used to remove slipperiness from roadways and/or pedestrian paths, h) manual and/or mechanical sweeping of roadways and pedestrian paths at the end of the season, i) emergency manual and/or mechanical sweeping of sand from bicycle paths that are not roadways at the end of the season, j) management of generated waste. 2. The detailed description and scope of work is specified in the Description of the Subject of the Contract (DSC) constituting Appendix No. 13 to the Technical Specifications. 3. Additional obligations of the Contractor arising from the social clause based on Art. 95 sec. 1 of the Public Procurement Law The Ordering Party requires that the Contractor or Subcontractor employs persons on the basis of an employment relationship throughout the entire period of contract performance, within the meaning of Art. 22 § 1 of the Act of 26 June 1974 - the Labor Code (Journal of Laws of 2026, item 1245, consolidated text) of employees directly performing activities related to the execution of the order, including: work related to winter cleaning of pavements, roadways and, as an emergency, bicycle paths. The above condition will be met by hiring new employees/employee under an employment contract or designating employees/employee already employed by the Contractor or Subcontractor to execute the order. Detailed requirements are specified in §17 of the Sample Contract - Appendix No. 12 to the Technical Specifications. 4. Option right - additional scope of services 1. As part of the execution of the contract, the Ordering Party, pursuant to Art. 441 of the Public Procurement Law, is entitled to commission the Contractor with an additional scope of work resulting from the Option right, specified in Appendix 14 to the Technical Specifications (Appendix 2a to the contract). 2. The Ordering Party is not obliged to exercise the Option right. Failure to exercise the Option Right does not constitute non-performance or improper performance of the contract. Zamawiający złoży oświadczenie o skorzystaniu z prawa Opcji zgodnie z treścią załącznika nr 2b do umowy w sytuacji, gdy zaistnieje taka potrzeba oraz gdy posiadać będzie środki na sfinansowanie zamówienia w zakresie objętym prawem Opcji i w okresie obowiązywania umowy. 4. W przypadku nieskorzystania przez Zamawiającego z prawa Opcji w całości, Wykonawcy będzie przysługiwać wynagrodzenie jedynie za prace zlecone i wykonane.
