The Ordering Party specifies the requirements related to the implementation of the subject of the order in terms of employment based on an employment relationship referred to in art. 95 in conjunction with art. 438 sec. 1 of the Public Procurement Law: 1. The Ordering Party, acting under art. 95 sec. 1 of the Public Procurement Law, hereby informs that it requires the Contractor and Subcontractor(s) to employ on the basis of an employment relationship persons who will perform activities within the scope of the order, consisting in performing work in the manner specified in art. 22 § 1 of the Act of 26 June 1974 – Labor Code. This requirement applies to individuals who perform activities directly related to the provision of services – if the performance of these activities involves the performance of work within the meaning of the Labor Code, unless these activities are performed personally by individuals conducting business activity. 2. The conditions referred to in point 1 above will be met by hiring new employees under a full-time employment contract or by appointing existing employees performing snow removal, plowing, and de-slimming activities to perform the contract. The procedure will be conducted according to the principles specified in Art. 139 of the Public Procurement Law (the so-called "reverse procedure").
