The subject of the order concerns the facilities listed in the material and quantitative scope constituting Appendix No. 12 to the Technical Specifications, and includes in particular: 1) 24-hour, full readiness of the Contractor to provide the services covered by the subject of the contract, which is understood as ensuring appropriate staff and equipment meeting the requirements of the Ordering Party, 2) 24-hour availability of the Contractors representative at two telephone numbers, enabling the Ordering Party to call the Contractor to provide the services covered by the subject of the contract, 3) 24-hour snow removal from sidewalks, pedestrian routes, pedestrian and bicycle paths and parking lots, indicated in Appendix No. 12 to the Technical Specifications, using cleared motor vehicles, tractors, bulldozers or other light machines adapted to the above-mentioned works, 4) 24-hour combating, preventing the formation and eliminating winter slipperiness of sidewalks, pedestrian routes, pedestrian and bicycle paths and parking lots, indicated in Appendix No. 12 to the Technical Specifications, using a mixture of natural aggregates (sand) with a grain size of up to 4 mm with road salt (content of at least 90% sodium chloride NaCl), with a weight composition of 80% aggregate + 20% salt, in the amount of 200 g of the mixture per 1 m2, using light agricultural gritters or spreaders, 5) 24-hour snow removal while simultaneously combating, preventing and eliminating winter slipperiness of pavements, pedestrian routes, pedestrian and bicycle routes and parking lots, indicated in Annex No. 12, using a mixture of natural aggregates (sand) with a grain size of up to 4 mm with road salt (content of at least 90% sodium chloride NaCl), with a weight composition of 80% aggregate + 20% salt, in the amount of 200 g of the mixture per 1 m2, with washed-out motor vehicles or light tractors, additionally equipped with light agricultural gritters or spreaders, 6) preparation of the mixture in composition and quantities referred to in points 4) and 5), from own materials,storage and loading of the mixture, 7) manual performance of the services specified in points 3), 4), and 5) on sections of sidewalks, pedestrian paths, pedestrian and bicycle paths, and parking lots that are inaccessible to mechanical equipment. The Ordering Party assumes that this type of work will cover approximately 15% of the total area designated for winter maintenance in this procedure. 4. The Ordering Party anticipates that the Contractor will use a mixture of sand and road salt as a winter slippery material, where the mixture will contain 20% road salt. The procurement and storage of winter slippery materials is the responsibility of the Contractor. The terms listed above mean: - sand – natural aggregate with a grain size of up to 4 mm; - road salt – should contain at least 90% sodium chloride (NaCl); - winter slipperiness – a phenomenon occurring on roads due to the formation of a layer of ice or frozen or compacted snow on surfaces. To prevent and eliminate winter slipperiness, measures should be used in accordance with § 2 and § 3 of the Regulation of the Minister of the Environment of 27 October 2005 on the types and conditions of use of measures that may be used on public roads, streets, and squares (Journal of Laws No. 230, item 1960). 5. Winter maintenance of sidewalks, pedestrian and bicycle paths, and parking lots will be performed 24 hours a day, every calendar day. The Contractor is obligated to maintain constant technical readiness and provide services throughout the duration of the contract. 6. The above-mentioned works will be performed depending on the Ordering Partys needs. The Ordering Party will pay the Contractor only for services actually performed. 7. The subject of the contract must be performed in accordance with the provisions of the Specifications of Technical Conditions, in accordance with the draft provisions of the public procurement agreement (Appendix No. 1 to the Specifications of Technical Conditions) - hereinafter referred to as the “draft contract”, and the offer submitted by the Contractor in the proceedings. 9. The conditions and deadlines for performance of individual works and the payment terms are specified in the draft contract. 10. The Ordering Party does not envisage awarding the contracts referred to in art. 214 sec. 1 item 7 of the Public Procurement Act. 11. Pursuant to art. 95 sec. 1 of the Public Procurement Act, the Ordering Party requires that the Contractor or a subcontractor employ, on the basis of an employment relationship, persons who will perform activities within the scope of the contract, consisting of driving vehicles, snow removal, gritting, snow removal and gritting, if the performance of these activities consists in performing work in the manner specified in art. 22 § 1 of the Act of 26 June 1974 - the Labor Code. 12. Detailed requirements regarding the implementation and enforcement of the requirement of employment based on an employment relationship are specified in the draft agreement. 13.
