Tender Summary
The Provincial Hospital named after Dr. R. Ostrzycki in Konin in Poland from Europe region has released this tender for 1. The subject of the contract is "Construction of a new bed block - relocation of the Gynecology and Obstetrics Ward, Neonatal Ward, and Pediatric Ward to 45 Szpitalna Street." 2. A detailed description of the subject of the contract is included in the design documentation constituting Annexes 2.1 to 2.3 to the Technical Specifications (SWZ) and the Annex entitled: "Amendments to the design documentation" containing amendments to the design documentation along with the Admissions Room Concept. 3. The conditions for the implementation of the subject of the contract are also included in the Draft Contract Provisions constituting Annex 7 to the SWZ. 4. The contract is co-financed from the budget of the Wielkopolska Region under Grant Agreement No. DZ-IV-A/21/2022. 5. The Contracting Authority has not divided the contract into lots and does not allow the submission of partial bids. The contract in question, i.e., the construction of a new bed block – relocating the Gynecology and Obstetrics Ward, Neonatal Ward, and Pediatric Ward – was not divided into lots due to the specific nature of the services and construction works covered by the contract. This specifically applies to the individual components of the contract, which are integrated in a way that precludes the possibility of one component operating without the other. This ensures the overall project is completed and eliminates the potential for the Contracting Authority to receive only a portion of the contract and thus be unable to ensure the proper functioning of the entire project. The contract covers a single investment project, which will be implemented based on a building permit. Furthermore, dividing the contract into lots would be detrimental to the Contracting Authority due to the risk of extending the projects completion time, increasing investment costs, and potentially causing technical problems during the implementation phase (incompatibility of solutions). Another argument against dividing the contract is the difficulty in coordinating the work and enforcing the rights arising from the guarantees, i.e., the "dilution" of responsibility among contractors of individual parts and the inability to obtain a single guarantee for the entire project. The possibility of dividing the contract, due to the aforementioned reasons (primarily related to technical aspects and work coordination), is also not included in the developed, multi-discipline design documentation, based on which the building permit was issued. 6. The Ordering Party does not allow the submission of variant bids. 7. The Ordering Party requires the bid to be submitted after the contractor has completed a site visit. Before preparing and submitting a bid, an inspection and site visit should be conducted to obtain the necessary information to accurately evaluate the future site for the execution of the subject of the contract. The site visit will enable Contractors to obtain information useful for bid preparation, including familiarization with the technical condition of the existing infrastructure.A written attendance list and minutes will be prepared from the on-site inspection, which, when signed by the Ordering Party and the Contractor, will constitute confirmation that the Contractor has completed the on-site inspection. The on-site inspection will be carried out on 28/07/2026, - Meeting at 10:00 AM at the entrance to the main hospital building (building D) at 45 Szpitalna Street in Konin. Pursuant to art. 226 sec. 1 item 18 of the Public Procurement Law, the Ordering Party rejects the offer if it is submitted without a on-site inspection at the Ordering Partys premises. 8. Requirements regarding the employment of persons under an employment contract. The Ordering Party requires the Contractor or subcontractor to employ, under an employment contract, persons performing the following activities within the scope of the implementation of the subject matter of the Agreement: physical work during the performance of construction works and associated works, excluding work performed by persons performing independent technical functions in construction within the meaning of the provisions of the Building Law - if the performance of these activities consists in performing work in the manner specified in art. 22 § 1 of the Act of 26 June 1974 – Labor Code. The principles of employing persons under an employment contract are specified in the Draft Contract Provisions, constituting Appendix No. 7 to the ToR. 9. The ToR together with appendices will be made available by the Ordering Party on the website of the conducted procedure: https://platformazakupowa.pl/transakcja/1293911 11. Failure to obtain a positive opinion on the advisability of the investment may be deemed to constitute circumstances rendering further proceedings unjustified and, consequently, may constitute grounds for invalidating the procedure. 12. The Ordering Party does not allow the exercise of the option right. 13. The subject of the contract must be performed in accordance with Polish Standards, with the currently applicable legal provisions in a given scope, including the provisions of the Construction Law Act, occupational health and safety and fire protection regulations, standards, knowledge and construction practices - other requirements in accordance with the provisions of Chapter IV of the Technical Specifications. 14.
