ANGIOGRAPH PHILIPS HEMO SYSTEM INTRA SIGHT AND SYNC VISION SOFTWARE AUTOMATIC SYRINGE MASTERYS 4 UPS FOR A PERIOD OF 36 MONTHS 2 The detailed scope of the order including a list of medical equipment covered by the subject of the order is presented in Appendix No 3 to the ToR Description of the Subject of the Order Other requirements regarding the performance of the subject of the order are specified in the draft contract provisions constituting Appendix No 9 to the ToR 3 If the Ordering Party indicates trademarks patents or the origin source or specific process that characterizes products or services delivered by a specific Contractor in the tender documentation the Ordering Party allows the use of equivalent solutions 1 Terms used indicating trademarks proper names patents or the origin of the subject of the order should be read together with the words or equivalent The Ordering Party allows the Contractor to use solutions equivalent to those indicated in the description of the subject of the contract Appendix No 3 to the ToR 2 when describing the subject of the contract by reference to standards technical assessments technical specifications and technical reference systems referred to in art 101 sec 1 item 2 and sec 3 of the Public Procurement Law the Ordering Party allows solutions equivalent to those described and such reference is accompanied by the words or equivalent 4 Electronic auction The Ordering Party provided in the contract notice that the selection of the most advantageous offer will be preceded by an electronic auction if at least two offers that are not subject to rejection are submitted in this procedure INFORMATION ON CONTRACTORS JOINT BIDDING FOR THE CONTRACT 1 Contractors may jointly compete for the award of a contract in accordance with the provisions of art 57-60 of the Public Procurement Law In such a case the Contractors shall appoint a proxy to represent them in the contract award procedure or to represent them in the procedure and conclude the public procurement agreement 2 In the event of joint application for a contract by Contractors the declarations referred to in Article 125 section 1 of the Public Procurement Law shall be submitted by each Contractor These declarations shall confirm the absence of grounds for exclusion and the fulfillment of the conditions for participation in the procedure to the extent to which each Contractor demonstrates compliance with the conditions for participation in the procedure in accordance with Article 125 section 4 of the Public Procurement Law 3 Contractors jointly applying for a contract shall be jointly and severally liable for the execution of the contract and for providing a performance security The provisions concerning the Contractor shall apply accordingly to Contractors jointly applying for a contract 4 Contractors jointly applying for a contract shall submit an appropriate power of attorney with their offer in accordance with Chapter XVIII item 10 sub-item 3 of the Public Procurement Law this does not apply to a civil partnership provided that the authorization power of attorney to act on behalf of this company results from the partnership agreement attached to the offer or all partners sign the offer Note The power of attorney referred to above may result either from a document under the same name or from an agreement between the Contractors jointly applying for the contract 5 The offer must be signed in such a way that it legally binds all Contractors acting jointly by each Contractor or an authorized representative 6 All correspondence will be conducted exclusively with the entity acting as the representative of the Contractors jointly applying for the contract 7 In the case referred to in Art 117 sec 2 or sec 3 of the Public Procurement Law the Contractors jointly applying for the contract are required to attach to their offer the declaration referred to in Art 117 sec 4 of the Public Procurement Law specifying which construction works supplies or services will be performed by individual contractors in accordance with Chapter XI items 2 and 3 of the Technical Specifications INFORMATION ON SUBCONTRACTORS 1 The Contractor may entrust the performance of part of the order to a subcontractor 2 In the case of entrusting the execution of the order to subcontractors the Contractor is obliged to indicate in the Offer Form the part of the order which it intends to entrust to subcontractors and to provide the names of any potential subcontractors if already known In the absence of such a declaration the Ordering Party will consider that the Contractor will perform the order without the participation of subcontractors Entrusting the performance of part of the order to subcontractors does not release the Contractor from liability for the proper performance of the order 3 The Ordering Party will not investigate whether there are grounds for exclusion with respect to a subcontractor that is not an entity providing resources referred to in Art 108 and Art 109 of the Public Procurement Law 4 The Contractor may not perform its obligation through subcontractors who are subject to exclusion on the basis of the grounds for exclusion indicated in - Art 7 sec 1 points 1-3 of the Act of 13 April 2022 on specific solutions to counteract support for aggression against Ukraine and to protect national security i e Journal of Laws of 2025 item 514 pursuant to the provisions of chapter XII point 1 subpoint 9 of the SWZ - art 5k of Regulation EU No 833 2014 concerning restrictive measures in connection with Russia s actions destabilizing the situation in Ukraine OJ EU L 2014 229 1 of 31 07 2014 as amended 5 In order to verify the circumstances referred to in the previous sentence the Contractor shall submit together with its offer a declaration in accordance with Annex 5 to the SWZ The Ordering Party is entitled to verify the grounds for exclusion of subcontractors also at the stage of contract performance by requesting the presentation of the declaration referred to in Annex 5 to the SWZ current at the time of submission 6 The Contractor in the event of relying on the technical or professional capabilities of entities providing resources also presents a declaration of the entity providing access in accordance with Annex 6 to the SWZ with tender notice no. 667053-2026 published on 07 Oct 2026.
