The Ordering Party allows for the submission of partial offers in accordance with the division of the subject of the contract specified in point 6.1. IDW SWZ. Based on art. 91 sec. 1 of the Public Procurement Law, the Ordering Party specifies that one Contractor may submit an offer for a maximum of two freely selected lots of the contract. The subject of the order covers the execution of the works for Part 1 in the period from 01.05.2027 to 30.04.2031, and if the contract is signed after 01.05.2027, it will be valid from the date of the official handover of the roads for maintenance until 30.04.2031, for Part 2 in the period from 01.09.2027 to 31.08.2031, and if the contract is signed after 01.09.2027, it will be valid from the date of the official handover of the roads for maintenance until 31.08.2031, for Part 3 in the period from 01.05.2027 to 30.04.2031, and if the contract is signed after 01.05.2027, it will be valid from the official handover of roads for maintenance until 30/04/2031, for Lot 4 in the period from 01/06/2027 to 31/05/2031, and if the contract is signed after 01/05/2027, it will be valid from the date of the official handover of roads for maintenance until 31/05/2031, whereas, for all Lot 4, the maximum total duration of the Contract, together with the option right referred to in § 1 sec. 8, may not exceed 48 months from the commencement of the contract, including year-round road maintenance, including winter and ongoing road maintenance, in particular: - maintenance of road surfaces and engineering structures, - maintenance of shoulders and central reservations, - maintenance of the road body, - maintenance of drainage, - maintenance of sidewalks and bicycle paths, - maintenance of markings, - maintenance of traffic safety devices, - maintenance of the aesthetics of signs, traffic safety elements and the road lane, - maintenance of support devices, - winter road maintenance, - Contract Management, - maintenance of cleanliness, as well as repair and maintenance works on engineering structures. The detailed scope of the subject of the contract required for execution is specified in the Description of the Subject of the Contract, Technical Specifications, Draft Contract Provisions. The Ordering Party provides for the possibility of exercising the option right referred to in Art. 441 sec. 1 of the Public Procurement Law. Under this contract, the Ordering Party provides for the possibility of exercising the option right in the scope of: 1) Execution of works on road sections other than those indicated in §1 sec. 1,located within the District whose roads are maintained under this Agreement, or within adjacent Districts within the structure of GDDKiA, specified in Appendix No. 15 to the Agreement to the extent specified in Appendix No. 2 to the Agreement – ​​Tables of Settlement Elements for works marked as works to be performed under option rights. These works will be settled at the prices specified by the Contractor for the basic order for these works. The above-mentioned prices for roads of the same cross-section and maintenance standard will be used to calculate the Contractor's remuneration; 2) the possibility of entrusting the Contractor with the performance of works, in the case referred to in § 3 sec. 2 – for a period not longer than 10 months – within the scope of the basic order, at the prices specified by the Contractor for the basic order in Appendix No. 2 to the Agreement – ​​Tables of Settlement Elements, Summary Cost Summary, while the maximum total term of the Agreement, including option rights, may not exceed 48 months. The Ordering Party reserves the right to personally perform the key tasks covered by the subject of the contract by the Contractor. The Contractor is obliged to personally perform the key tasks specified in Group of Works No. 11 – Contract Management, reserved by the Ordering Party, in accordance with Art. 121 of the Public Procurement Act, i.e. the activities performed by the following members of the Road Maintenance Team: - Road Maintenance Manager; - Deputy Road Maintenance Manager. With respect to a key task reserved for personal performance by the Contractor, the Contractor may not rely on the capabilities of the entity providing resources, under the principles specified in Art. 118 sec. 1 of the Public Procurement Act, in order to demonstrate compliance with the relevant conditions for participation in the procedure.Contract value exceeding EUR 140,000.
