The 21 Baza Lotnictwa Taktycznego in Poland from Europe region has released this tender for The subject of the contract is the performance of services consisting in cleaning and maintaining external hardened surfaces and maintaining green areas located within the area of ​​responsibility of the 21st Tactical Air Base in Świdwin, i.e. in the garrison of Świdwin, Mrzeżyno, Trzebiatów and Mirosławiec for 2027. 1. Before awarding the contract, the Contracting Authority will request the Contractor whose offer was evaluated the highest to submit, within a specified deadline of no less than 10 days, the following declarations or documents, current as of the date of submission, to confirm that the Contractor is not subject to exclusion from the procedure and meets the conditions for participation in the procedure: a) current information from the National Criminal Register within the scope specified in art. 108 sec. 1 items 1, 2 and 4 of the Public Procurement Law, issued no earlier than 6 months before its submission; a Contractor that relies on the resources of other entities in order to demonstrate the absence of grounds for exclusion with respect to them shall also submit the above-mentioned information from the National Criminal Register with respect to these entities. b) declaration of the Contractor/entity providing resources on the validity of the information contained in the declaration referred to in art. 125 sec. 1/125 sec. 5 of the Act, within the scope of the grounds for exclusion from the procedure indicated by the contracting authority: - art. 108 sec. 1 item 3 of the Public Procurement Act: - art. 108 sec. 1 item 4 of the Public Procurement Act regarding the imposition of a ban on applying for a public contract as a preventive measure, - art. 108 sec. 1 item 5 of the Public Procurement Act regarding the conclusion of an agreement with other contractors aimed at distorting competition, - art. 108 sec. 1 item 6 of the Public Procurement Act, and - art. 7 sec. 1 of the Act of 13 April 2022 on specific solutions to counteract support for aggression against Ukraine and to protect national security (Journal of Laws of 2022, item 835), (hereinafter referred to as the "Act"), - Art. 5k of Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russias actions destabilizing the situation in Ukraine (hereinafter referred to as the "Regulation"), consistent in content with Annex No. 11 to the SWZ c) declarations of the Contractor (entity providing resources), within the scope of Art. 108 sec. 1 point 5 of the Act, on not belonging to the same capital group within the meaning of the Act of 16 February 2007 on Competition and Consumer Protection (Journal of Laws of 2023, item 1689), with another contractor who submitted a separate offer, partial offer or application to participate in the procedure, or a declaration of belonging to the same capital group together with documents or information confirming the preparation of an offer, partial offer or application to participate in the procedure independently of another contractor belonging to the same capital group, consistent with the content of Annex No. 12 to the Technical Specifications, d) a list of services performed, and in the case of periodic or continuous services also performed,over the last 3 years, and if the period of business activity is shorter – during that period, together with the value, subject matter, dates of performance and the entities for which the services were performed (in accordance with the content of Appendix No. 6 to the ToR), and attaching evidence specifying whether the services were performed or are being performed properly, whereby the evidence in question shall be references or other documents issued by the entity for which the services were performed, and in the case of periodic or continuous services, and if, for a justified reason of an objective nature, the contractor is unable to obtain these documents – a declaration by the contractor; in the case of periodic or continuous services still being performed, references or other documents confirming their proper performance should be issued no earlier than 3 months before the deadline for submitting tenders or applications to participate in the procedure). e) a list of technical equipment available to the Contractor for the purpose of performing the public contract, together with information on the basis for disposing of these resources, in accordance with the content of Appendix No. 7 to the ToR. No later than the date of contract signature, the Contractor is obligated to submit: a) a consortium agreement (in the case of a consortium) and a civil law agreement (in the case of a civil partnership). The documents submitted must clearly indicate the scope of cooperation between the contractors jointly applying for the contract; b) a declaration of employment under an employment contract for the persons performing services for the Ordering Party, along with a list of employees employed under the contract (first and last name only).
