The SN TIMISOARA TRAIAN VUIA INTERNATIONAL AIRPORT SA in Romania from Europe region has released this tender for The object of the contract provides for: • Acquisition of the realization of the Technical Project • Acquisition of installations/equipment for the creation of a new capacity for the production of electricity from renewable sources of solar energy, with storage – installed CEF capacity 6.5 MWp, BESS – 10 MWh and heat pumps of 700 kWt; • Execution of construction/assembly works for the purpose of putting into operation the unit for the production and storage of electricity and the capacity for the production of the thermal agent. Through this investment project, the applicant SN AEROPORTUL INTERNATIONAL TIMISOARA TRAIAN VUIA SA has as its main objective the creation of a new capacity for the production of electricity from renewable resources, respectively from solar energy with the creation of a new integrated storage capacity for electricity (behind the meter), installation of heat pumps. The main technical and economic information is provided in the Feasibility Study. The estimated value of the design, supply and execution contract for the “7MW PHOTOVOLTAIC PARK” project is 43,674,338.14 lei excluding VAT. IMPORTANT! The procedure for awarding the public procurement contract is initiated under the incidence of this suspensive clause, in the sense that the conclusion of the public procurement contract is conditioned by the signing of the financing contract. Considering the provisions of Law no. 99/2016 on public procurement and GD. no. 394/2016, with subsequent amendments and completions, the contracting entity specifies that it will conclude the contract with the successful bidder only to the extent that the financing contract is signed. If, for any reason, the financing contract is not signed, the Contracting Entity reserves the right to cancel the award procedure, provided that there is no other source of financing, in accordance with the provisions of Law 99/2016 with subsequent amendments and completions, making it impossible to conclude the public procurement contract. The bidders in this procedure understand that the contracting entity cannot be held liable for any damage in the event of cancellation of the award procedure, regardless of its nature and regardless of whether the contracting entity has been notified of the existence of such damage. The bidders in this procedure accept the use of the special conditions above the suspensive clause, assuming full liability in relation to any damage they may suffer in the described situation. We note that SN AEROPORTUL INTERNATIONAL TIMISOARA „TRAIAN VUIA” SA, JUDETUL TIMIS, LOC. GHIRODA, STR. AEROPORT, NR. 2 has not signed a financing contract with the Ministry of Transport and Infrastructure. The suspensive clause is proposed as a means to accelerate the implementation of projects, in order to achieve the proposed objectives. In law, attention is drawn to the provisions of art.1399 et seq. of the Civil Code, respectively "the obligation whose effectiveness or termination depends on a future and uncertain event is affected by the condition" and "the condition is suspensive when the effectiveness of the obligation depends on its fulfillment". Thus, the suspensive clause is permitted under common law, and the standard data sheet format developed by ANAP explicitly mentions the possibility of such clauses at point IILl.4) The execution of the contract is subject to other special conditions. The suspensive clause specifies that the source of financing for the tendered contract is not assured at the time of the tender. Note: The estimated value of the contract does not include the amount related to miscellaneous and unforeseen expenses, provided for in the general estimate, which can be accessed as appropriate, depending on the needs.
