The PITESTI MUNICIPALITY - LOCAL COUNCIL OF PITESTI MUNICIPALITY in Romania from Europe region has released this tender for Design services technical verification technical assistance from the designer during the execution of the works and the execution of the construction-assembly works related to the project Energy efficiency of Mihai Eminescu Junior High School The contract is not divided into lots The number of days until which clarifications can be requested before the deadline for submission of offers established by the contracting authority is 18 days The contracting authority will respond fully to all requests for clarifications on the 11th day before the deadline for submission of offers To the extent that requests for clarifications or additional information were addressed within the deadline set in the tender notice the contracting authority will respond to all requests for clarifications within the deadline set by the award documentation This procedure is initiated with a suspensive clause The award procurement procedure is initiated under the present suspensive clause in the sense that the conclusion of the public procurement contract is conditional on the conclusion of the financing contract the signing of the contract being made in compliance with the provisions relating to the commitment of expenditure from the budgets falling under the legislation on public finances Taking into account the provisions of Law no 98 2016 and GD no 395 2016 with subsequent amendments and completions the Contracting Authority specifies that it will conclude the contract with the successful bidder only to the extent that the funds necessary for the acquisition will be ensured by signing the financing contract within the PRSM 2021-2027 with the Regional Development Agency ADR Sud-Muntenia If for whatever reason the financing contract is not signed the Contracting Authority after receiving notification from the Regional Development Agency ADR Sud-Muntenia regarding the non-granting of financing reserves the right to cancel the award procedure provided that there is no other source of financing in accordance with the provisions of art 212 paragraph 1 letter c sentence 2 of Law no 98 2016 with subsequent amendments and completions making it impossible to conclude the public procurement contract The bidders in this procedure understand that the Contracting Authority and or the Regional Development Agency ADR Sud-Muntenia that provides the financing cannot be held liable for any damage in the event of cancellation of the award procedure regardless of its nature and regardless of whether the Contracting Authority and or the Regional Development Agency ADR Sud-Muntenia have been notified of the existence of such damage The tenderers in this procedure accept the use of the above special conditions suspension clause assuming full liability for any damages they may suffer in the situation described In applying the aforementioned suspensive clause if the financing decision is not issued by the date of expiry of the initial validity period of the offer the Contracting Authority has the right to request the contractor to extend the validity period of the offers and accordingly of the participation guarantee The tenderers are obliged to respond to the request within the period indicated by the Contracting Authority a negative response or the lack of a response within the requested period entails the impossibility of signing the contract the respective offer being considered withdrawn without this fact entailing the execution of the participation guarantee with tender notice no. 664110-2026 published on 07 Oct 2026.
