The CNCF "CFR" SA - REGIONAL BRANCH CF CLUJ - OPERATIONAL UNIT in Romania from Europe region has released this tender for The provider will develop the documentation regarding the design service in the "Feasibility Study" stage, in accordance with the provisions of the Constitutional Court no. 46/A/170/22.09.2026, 46/A/171/22.09.2026, 46/A/172/22.09.2026, GD 907/2016, Law 10/1995, Law 50/1991, Law 500/2002. SUSPENSION CLAUSE: The award procedure is carried out under the incidence of this suspensive clause. The conclusion of the contract with the op. ec. which will be declared the winner following the completion of the sectoral procurement process, in order to carry out the services related to these objectives is conditional on obtaining/approving the financing of the services, the signing of the contract being possible only in the event that the provisions ref. to the commitment of expenses from the budgets falling under the incidence of the legislation are complied with. on public finances. If, for any reason, the obtaining/approval of the financing of services from funds from the state budget and/or external non-reimbursable funds is not achieved, after receiving notification from the competent authority regarding the non-granting of financing, the EC reserves the right to apply the provisions of art. 225 paragraph (1) letter c) of Law 99/2016 as updated: "if violations of the legal provisions affect the award procedure or if it is impossible to conclude the contract". The bidders participating in this procedure understand that the EC and/or the MTI and any other functional structure involved in the implementation of this project and/or the Government of Romania, cannot be considered liable for any damage, regardless of its nature, in the event of the cancellation of the award procedure/failure to sign the service contract within the proposed deadline, and accept the use of the special conditions stated - the suspensive clause, assuming full liability in relation to any damage they may suffer in the described situation. It is estimated that the period during which the suspensive clause applies is 12 months from the approval of the procedure report. The EC estimates that it is possible to obtain the necessary financing for the signing of the contract in the second half of 2026, respectively the first half of 2027. Given this aspect, the bidders will consider extending the validity of the offer and the participation guarantee, at the request of the EC, until the signing of the contract. According to Decision no. 4/14.03.2024 of the Board of Directors of CNCF” CFR” SA, after the completion of all activities related to the signing of the contract (approval of the procedure report, finalization of appeals, etc.), the Board will be requested to approve the signing of the contract in accordance with the applicable legal provisions in force.
