Tender Summary
The Foisor Clinical Hospital for Orthopedics, Traumatology and Osteoarticular TB in Romania from Europe region has released this tender for For the purchase of the products Miscellaneous sanitary materials related to lots 1-4, the estimated value of all purchases with the same object or identical or similar uses was taken into account, information based on which the procedure established for the procurement process is established and included in the annual public procurement program. The formation of the lots was achieved by including in their composition only similar products, as defined by art. 18 of Law no. 98/2016 on public procurement. The division of these products into lots is not justified since they are part of the same category of products, being similar as defined by art. 18, fulfilling the 2 conditions, and beyond these proven and provable aspects, according to art. 53 of Law no. 98/2016: "Any economic operator has the right to participate in the award procedure as a tenderer or candidate, individually or jointly with other economic operators, including in forms of temporary association established for the purpose of participating in the award procedure, under the conditions provided for by this law". The interest of the contracting authority is not to restrict the access of any potential tenderer to the procedure, but on the contrary, to ensure competition and equal treatment for all interested parties so that the purchased products also comply with the principles of effectiveness, economy and efficiency in the use of public funds. The Clinical Hospital carries out purchases with a large volume of products in the category of general and specific sanitary materials, disposable medical products/consumables, spare parts, disinfectants, reagents, etc., a situation that makes it impossible to organize award procedures having as object each product a batch, which leads us to group the products used in the operating room/intensive care unit/ward under a single batch. Taking into account that the mentioned products are interdependent during a procedure of preparing the patient and isolating him after the incision/operation, and a delay in the delivery of one of the products purchased from different suppliers makes it impossible to carry out the medical act. Therefore, the contracting authority cannot define the object of a lot according to the product portfolio of each economic operator whose object of activity is the supply of products such as those requested. At the same time, we specify that economic operators, who are not able to fulfill jointly and autonomously the object of the public procurement contract, through art. 53 of law no. 98/2016, have the possibility of forming associations of economic operators, which together participate and successfully fulfill the object of the framework agreement. At the same time, the supply of products by a single supplier ensures at the same time all the premises for obtaining an advantageous price, economically competitive (single shipment, discounts, higher from the manufacturer in relation to quantities) The division into lots represents a right of the contracting authority and not an obligation, an aspect that results from art. 141 paragraph (1) of Law no. 98/2016, which the contracting authority has already done. Therefore, given the above, it can be concluded that the decision to divide a procurement into lots lies with the contracting authority, being regulated as its right, and not as an obligation, and the non-use of this right being mandatory to be justified by it. The number of days until which clarifications can be requested before the deadline for submitting offers is 18 days. The contracting authority will respond clearly and completely to all requests for clarifications on the 11th day before the deadline for submitting offers with tender notice no. 719577-2026 published on 19 Oct 2026.
