SECUIESC will be carried out under the following suspensive clause: The procedure for awarding the public procurement contract is initiated under the incidence of this suspensive clause, in the sense that the conclusion of the public procurement contract is conditional on the allocation of budgetary credits for this purpose from the funds of the Ministry of Health, the signing of the contract being made in compliance with the provisions relating to the commitment of expenses from the budgets falling under the incidence of the legislation on public finances. Taking into account the provisions of Law 98/2016 on public procurement and H.G. no. 395/2016, with subsequent amendments and completions, the Contracting Authority specifies that it will conclude the contract with the tenderer declared the winner only to the extent that the funds necessary for the acquisition will be ensured by the allocation of budgetary credits for this purpose. If, for whatever reason, the budget credits are not allocated, for a period of 24 months from the date of approval of the procedure report, the Contracting Authority, after receiving the notification regarding the non-granting of financing, reserves the right not to conclude the procurement contract and to cancel the procedure, provided that there is no other source of financing, in accordance with the provisions of art. 212 paragraph (1) letter c) sentence 2 of Law 98/2016 with subsequent amendments and completions, the conclusion of the public procurement contract being impossible. The bidders in this procedure understand that the Contracting Authority cannot be held liable for any damage in the event of cancellation of the award procedure, regardless of its nature and regardless of whether the Contracting Authority has been notified of the existence of such damage. Bidders in this procedure accept the use of the above special conditions/suspension clause, assuming full liability for any damages they may suffer in the situation described. The maximum period for which the suspensive clause operates is 24 months, so that, if the condition regarding the granting of financing is not met, the award procedure is cancelled.
