Procurement of Energy Audit Services, Structural Technical Expertise and Development of DALI (Documentation for Approval of Intervention Works) to Increase the Energy Efficiency of Public Buildings in the South-Muntenia Region

The Agentia pentru Dezvoltare Regionala Sud Muntenia in Romania from Europe region has released this tender for II.1.4) Short description: Procurement of Energy audit services, structural technical expertise and development of DALI (Documentation for approving intervention works) for increasing the energy efficiency of public buildings in the South-Muntenia Region The procedure for awarding the public procurement contract is initiated under the incidence of this suspensive clause, in the sense that the conclusion of the public procurement contract is conditional on the signing of the additional act regarding the extension of the implementation period of the ELENA project. The signing of the public procurement contract will be carried out only under the conditions in which the additional act is signed and becomes enforceable, in accordance with the applicable legal provisions regarding the commitment of expenses from budgets financed through projects with non-reimbursable financing. Considering the provisions of Law no. 98/2016 on public procurement and of GD no. 395/2016, as subsequently amended and supplemented, the contracting authority specifies that it will conclude the contract with the successful bidder only to the extent that the extension of the ELENA project is formalized by the corresponding additional act. If, for any reason, the additional act regarding the extension of the ELENA project is not signed, and the contracting authority is notified in this regard, it reserves the right to cancel the award procedure, to the extent that there is no other source of financing, in accordance with the provisions of art. 212 para. (1) let. c) of Law no. 98/2016, as subsequently amended and supplemented, since it becomes impossible to conclude the public procurement contract. The tenderers participating in this procedure understand and accept that the contracting authority cannot be held liable for any damage, of any nature, that may arise from the cancellation of the procedure as a result of the failure to sign the additional act extending the ELENA project, even if the existence of such damage has been notified to it. The tenderers expressly accept the special conditions provided for in this suspensive clause and assume full responsibility for any consequences or damage that may arise in the aforementioned situation. The maximum period for which the suspensive clause operates is 6 months from the date of approval of the procedure report. In accordance with the provisions of art. 160 para. (2) of Law no. 98/2016, the contracting authority sets a single deadline for requests for clarifications formulated by economic operators and to respond clearly and completely to all requests for clarifications/additional information that may be requested during the tender submission period. Considering the possibility of selecting the award procedure in the ANAP ex-ante verification program,when setting the deadline, the deadline necessary for the verification of the response proposal by ANAP was also taken into account in accordance with the provisions of art. 8 paragraph (2) of GD no. 419/2018: "The contracting authority is obliged to send to ANAP the proposal for a consolidated response formulated to the requests for clarifications/additional information at least 4 days before the deadline or, as the case may be, the response deadlines established by the tender notice/simplified tender notice/contest/concession notice." Number of days until which clarifications can be requested: 20 days before the deadline for submission of tenders. The contracting authority will respond clearly and completely to all requests for clarifications, according to the provisions of art. 161, paragraph (1) of Law no. 98/2016, on the 11th day before the deadline for submission of tenders.
