The VIYSHKOVA CHASTINA 2382 in Ukraine from Europe region has released this tender for Inclusion of the following requirements by the tenderer: - Cabinet of Ministers of Ukraine Resolution No. 187 dated 03.03.2022 'On ensuring the protection of national interests in future state claims of Ukraine in connection with Russian Federation's military aggression'; since the Contractor cannot fulfill obligations to creditors who are the Russian Federation or persons associated with the aggressor country as defined in subsection 1 of paragraph 1 of this Resolution; - Cabinet of Ministers of Ukraine Resolution No. 426 dated 09.04.2022 'On the application of the ban on importing goods from the Russian Federation'; since this Resolution prohibits the import of goods from the Russian Federation onto Ukraine's customs territory in customs regime; - Law of Ukraine No. 1207-VII dated 15.04.2014 'On ensuring citizens' rights and freedoms and the legal regime on temporarily occupied Ukrainian territory'. Also, Contractors are prohibited from conducting public procurement of goods, works, and services from: - citizens of the Russian Federation / Republic of Belarus / Islamic Republic of Iran (excluding those residing on Ukrainian territory on legal grounds); - legal entities established and registered in accordance with the legislation of the Russian Federation / Republic of Belarus / Islamic Republic of Iran; - legal entities established and registered in accordance with Ukrainian legislation, whose ultimate beneficial owner, member, or participant (shareholder) holds 10% or more of the statutory capital (hereinafter referred to as 'assets') which are the Russian Federation / Republic of Belarus / Islamic Republic of Iran, citizens of the Russian Federation / Republic of Belarus / Islamic Republic of Iran (excluding those residing on Ukrainian territory on legal grounds), or legal entities established and registered in accordance with the legislation of the Russian Federation / Republic of Belarus / Islamic Republic of Iran, except in cases where the assets are transferred to the National Agency for the Identification, Search, and Management of Assets Obtained from Corruption and Other Crimes in accordance with the established legal order; - Contractors are prohibited from conducting public procurement of goods originating from the Russian Federation / Republic of Belarus / Islamic Republic of Iran, except for goods originating from the Russian Federation / Republic of Belarus necessary for the repair and maintenance of goods acquired prior to the implementation of Cabinet of Ministers of Ukraine Resolution No. 1178 dated 12.10.2022 'On the establishment of special features for public procurement of goods, works, and services for contractors specified in the Law of Ukraine 'On Public Procurement' during the period of the legal regime of the state of war in Ukraine and for 90 days from the date of termination or cancellation of this regime', with amendments. 7.7. Non-resident participants submit documents required by this tender documentation in accordance with the laws of the country where they are registered. If a document is not required by the laws of the country where the non-resident participant is registered, they submit a certificate in any form with justification for the absence of the required document.
