Contract for the operation of Banedanmarks sleeper factory

The Banedanmark in Denmark from Europe region has released this tender for Banedanmark wishes to enter into a contract with an operations supplier who can manage the daily, ongoing operation of Banedanmark's sleeper factory located at Vejlbyvej 1, 7000 Fredericia and thus, using the sleeper factory's production equipment, produce and deliver concrete sleepers in the form of line sleepers and switch sleepers, including sleeper types for special track structures such as rail extensions at bridges, in prestressed concrete for use in Banedanmark's performance of its task as railway infrastructure manager. Production is carried out using the long line method. In this connection, the operating supplier must, among other things: - Ensure rational and economically sound production and delivery of concrete sleepers of the types Line Sleepers and Switch Sleepers in accordance with the terms of the contract, - As a minimum, meet the requirements of DS/EN ISO 9001:2015 or a corresponding standard for quality management system, cf. Appendix 5 - Ensure quality assurance of sleeper production, - Continuously cooperate with Banedanmark on organizing the operation of the Sleeper Factory, including participating in cooperation meetings, - At its own expense, purchase the necessary raw materials and materials that are included in the production, to the extent that these are not, according to the contract, client deliveries that Banedanmark delivers, - Provide the necessary technical and administrative expertise for the operation of the Sleeper Factory, including advising Banedanmark on the development and adaptation of production, - Assist Banedanmark in connection with changes to the Sleeper Factory, including conversion of the production equipment with a view to the production of other sleeper types, - Contribute to an appropriate organizing and carrying out the collection of sleepers from the factory, including supervising the loading of sleepers in connection with the transport of finished sleepers from the Sleeper Factory. For information on the historical production of sleepers, please refer to Appendix 17 to the contract. The operating supplier is expected to take over responsibility for the operation of the sleeper factory on 1.1.2028. The period from 1.9.2027 and expected to 31.1.2028 is considered an establishment period. During this period, the parties will cooperate closely to establish the basis for stable and efficient operation of the Sleeper Factory as soon as possible in accordance with the terms of the contract. Reference is also made to Appendix 6, establishment schedule. The daily management of the Sleeper Factory must be supervised by a factory manager. The factory manager must be employed by the Operating Supplier (Banedanmark's contractual party). Communication between the factory manager appointed by the Operating Supplier and Banedanmark must take place in Danish. The contract does not prevent Banedanmark from purchasing sleepers from third parties. Banedanmark is entitled to resell sleepers to third parties. Consolidated Act No. 710 of 20.8.2002 on the legal status of employees in the event of a transfer of a business, as amended (Transfer of Business Act) applies in connection with the Operator's assumption of responsibility for the operation of the Sleeper Factory.
